      Thanks for that, very useful, I think I’ll have a change of tactic here in my reply in regards to the OFT Guidelines:

      Communication 3.2

      As there has clearly been breached of this in a misleading manner by this latest letter, and by Lowell’s previous actions requesting full payment on alleged debt from 2011 onwards that was then contradicted by the original creditor (Barclaycard) in August 2012 by written confirmation to myself that they (Barclaycard) are still the original creditor and no assignment of credit has taken place.

      This was until a letter recived very shortly after from Barclaycard dated 12th October 2012 stating assignemnt took place in July 2011 in the same evelope as a letter from Lowells 'Introducing' themsevles!!! (i have the envelope)

      So just to confirm this alleged debt has:

      1) No original CCA, and was taken out in 2004. Reconstructions provided by CCA request and SAR, advised original required various times.
      2) DN is defective due to lack of original creditors address and time frame due to Bank Holiday. Barclaycard have not provided me with a further copy to confirm this that was requested in August 2012 so I would make a good presumption that no copy would be available.
      3) Bryan Carter, Lowell’s and various other DCA’s have been trying to collect this alleged debt from 2011 onwards whilst the original creditor (Barclaycard) confirmed no assignment of credit had even take place right up till August 2012.

      What would be best course of action to proceed here now as I have various points to either leave out or focus on.

            I shall be writing back to them requesting an explaination as to why they even wrote to me in the first place if they had not been 'formally instructed in this matter' because the orgional letter quite clears states and opens with 'We have been instructed by Fredrickson...to write to you'

            If you receive a letter from a supposed solicitor you would expect at a minimum they had the knowledge of the account they are writing to you about and offer.

            I shall be composing a reply to them over the weekend, all input welcome

              Well I decided not to bother with BCS as they clealy have zero powers in this case, however letter from Fredrickson International ltd recived, anyone what to play a game of spot the error which would make this entire alleged debt status barred anyhow?

                Just been looking at my files again and forgot about this.

                What would be the best and quickest course of action to challenge Lowells's?

                I have heard nothing from them for a long time.

                I think the key element here is them trying to collect this alleged debt before the original creditor (Barclaycard) had even provided a notice of assignment, Barclaycard confirmed no assignemtn of debt had taken place right upto August 2012 yet Lowells had been trying to collect alleged debt for well over 12 months prior to this.

                  hi, not sure if i'm following correct protocol in asking this on this forum...but I am currently getting letters from Lowell/red and drysdenfairfax regarding Barclaycard and a capital one card.....none of which I have held since 2008....I was made redundant at this time and wasn't able to make payment.....haven't heard anything from either until recently when I started getting letters from the above companies....as yet I have just ignored them but the letters are becoming more and more frequent and ive started to get phone calls too.any advice would be greatly appreciated..
