    Hi all firstly id like to thank this forum for the information and advice i recieved last year, I had terrible troubles with welcome finance to the point i couldnt east,sleep etc, but thanks to the advice from this site 5 days before xmas (2010) i recieved a fat cheque for 2k for my mis sold ppi wow as a single mum what a xmas me and my 2 kids had , we shopped til we dropped with 2 fingers up at welcome so i totally thankyou and advise anyone having problems listen to these guys i never expected to get a penny thought i would loose my car but nope still got the car and 2k woop woop lol
    I just wondered really the fact that i won the ppi and the ombudsman was involved have they written my account off , because since the day i sent off for my sar ive never heard from them since, not a single letter phone call nothing (no contact in approx 18 months)
    i bought the car in 2007 finance approx 11 000
    i paid 6000 off the vehicle so there was still outstanding money im wondering if reclaiming the ppi and the ombudsman involvement have they decided to wipe it and if so where does that leave me with regards to if i wanted to sell the vehicle,
    any suggestions much appreciated

    The PPI has nothing to do with your ownership of the car. The 2k is yours.

    If im reading you correctly, they have also written off the remaining balance of the account? If thats the case, then the car is yours to sell, smash up, set on fire, jump up and down on the roof - whatever you want really.

    Id double check to make sure that you have in writing that the company has written off the balance, and im pretty sure you will have not being paying them any money since that decision.

    *edit* re-reading that, it looks like you dont know for sure if they have wiped the balance? Are you still paying them a monthly amount? If there is outstanding finance on the car, then its not yours to sell. If Welcome wont talk to you about the account and you want to know if they still have an 'interest' in the car, then a HPI check will reveal if the car has any outstanding finance on it http://www.checkthisreg.com/.

      Great to hear about your £2000 - well done!

      With regards to Welcome, you may know that they have been going through some serious difficulties recently. This has meant that their parent company is taking over the accounts, and many people who owe them money are not hearing anything at all. They seem to be offering large discounts for early settlement to try to maximise their cash flow, and also appear to be putting their efforts into the accounts that seem easiest to collect.

      I certainly would not take it for granted that you will not hear about this debt again. You may not hear from Welcome, but I suspect it may raise its head with a DCA at some point in the next year or two.

      The hpi check is an excellent idea if you think they may have written off the balance of the account.

        it used to be that teh finance was registered with exerian not hpi so it would be worth check with them . welcome used to be too tight to register an interest in cars with more than one agency .

          After almost three years in dispute with this terrible company we have had three demands from a DCA called Incasso sent "prove" it letters each time.
          This last time they got a bit nasty and tried to call us both at work and at home now sent a CCA to them ( I already did this with Welcome and the documents they sent were not relevant to the alleged debt)
          Downside is the Fos say they cannot rule on the enforceability only on PPI, received an offer but this would not , they say, "clear" this.
          Went to the CAB who agrees that is is questionable they should do this and that we should try and claim back the PPI on the old numbers That we do have
          Do you have a chance do you think we have a chance no intetion of contacting them until I hear from them!

              Firstly, it would be wise to write to Welcome Finance's new owner and ask them to confirm, in writing, whether the outstanding balance on your car loan has been written off. Send the letter by Special Delivery, not Recorded Delivery. It may cost more, but delivery is guaranteed and they will not be able to claim later that they did not receive your letter. Ask for a reply within seven (7) calendar days. Do not accept any waffle from Welcome Finance's new owner that they will respond in their own time. I have found from experience that it is best to keep firms that act like Welcome Finance have on a short leash.

              Those financial businesses found to have "mis-sold" PPI or any financial product are not permitted to use any repayments due to clear any outstanding balance on finance or whatever. The reason for this is that "mis-selling" is, technically, Fraud by False Misrepresentation (Section 2, Fraud Act 2006) and any premiums paid are, technically, classed as stolen property. The law is very clear that the ownership of any stolen property remains vested in its original and legitimate owner.

              If there is any outstanding balance on your car loan, Welcome Finance's new owner should tell you what the outstanding balance is and make arrangements with you as regards clearing this outstanding balance. One thing they will not be permitted to do is pass it to a DCA without giving you the opportunity to set up repayment arrangements. If they try to do that, Welcome Finance's new owners and any DCA they employ could both be putting their CCA licences at risk of being revoked.

              Go to the OFT's website and download an up to date copy of their Debt Collection Guidelines. This is a very useful document for dealing with DCAs and finance companies as it sets out clearly what they are and are not allowed to do. Quoting from the guidelines in dealings with finance companies and DCAs tends to make them nervous as they quickly realise you can catch them out and counter any bull they may come out with.

              Check with Welcome Finance's new owners just to be sure and for peace of mind. If there is any outstanding balance, remember that the law is on your side and you can report them and any DCA to the OFT for investigation and enforcement action, if necessary.

                Just spent the day trying to sort out the confusion that this company (along with others of its ilk) seem to create. Several things going on at the same time because there are always too many things questionable to actually deal with so you have to whittle it down to a few and then deal with those.

                I've copied absolutely everyone I can think of into the correspondence, including OFCOM for the second formal complaint regarding telephone harrassment.

                I have a batch of letters, one aching head and yet another day in my life that I'll never get back thanks to these people.

                I wonder where our money went, that's quite a large hole they're investigating:

                  I have been give some more phone numbers today, after speaking to the FSCS.
                  One of the "accounts" with Welcome is from 2002 so you have to go through the actual underwriters.
                  The numbers he gave me are
                  Direct Group 0844124141
                  Aviva (Norwich Union) 08001584058
                  I have spoken to Aviva and they are looking into this. said it could take up to twenty one days
                  Also the other account which, as well as PPI had Life Care, Home Care,
                  and Medicare added.
                  Sums involved range from just over two grand to £125
                  Maybe worth you checking any documents and contacting Aviva if they are the underwriters
                  Never give up, Never surrender.

                    Welcome only sent part SDAR and the underwriting sheet is one of the things I request on a weekly basis, along with all other information relating to the account. Along with Swift, letters are sent every Monday requesting everything.

                    I add on Welcome's a para about their refusal to deal with a third party (this is not my loan) and that their sketchy transcript of calls which has been 'cosmetically enhanced' to make them look good, states that I have put the phone down on them more than once. That is a blatant lie and I added to the weekly letter that I am prepared to swear under oath that I have never put the phone down on them.

                      Welcome are slippery as eels, and Cattles are struggling to collect any Welcome accounts successfully - Welcome themselves are still trying to collect some.

                      Their usual tricks including failing to respond completely to CCA requests, only partly complying with SAR's, claiming things happened on the telephone that never happened in reality, lying about the state of peoples' accounts, not being able to produce understandable statements of account - the list is endless. This, along with another favourite of haing rescheduled a loan when a customer got into difficulty, so you end up dealing with two loans and a nightmare scenario over any ppi sold / mis-sold.

                      I urge everyone dealing with WFS or Cattles to insist everything is only in writing, and refuse point blank to deal in any other medium. The OFT Debt collection Guidelines are quite clear that they should correspond through your medium of choice.

                            All these companies shouldn't have been so quick to diss our credit ratings because the threat 'this could affect your credit rating' has become commonplace and we get reported even when we don't owe money (as per my Santander experience). That threat, their greed and their refusal to do things properly have resulted in them becoming toothless lions.

                            Off-topic slightly Labman but the next batch of potential rip-offs winging its way from across the pond are companies specialising in cleaning up our credit ratings. we may already have them of course but when I googled the sites appeared to be all US based. Now, these may be bona fide compaies who charge a reasonable amount for doing a good job but I am just too cynical these days. Maybe it's something you'll be able to bring up at some point as I'd rather do it myself if at all possible.

                              I had a loan with welcome finance in 2007. I probably paid back about half before getting into difficulty. Obviously the statute of limitations applies now but how would I be able to find out if I had ppi with them without any of the information?
