Accept Or Not??

Recently,after a long drawn out court argument which lasted 3 years the owners of our car have a return of goods order. The agreement was covered by CCA. They have agreed, through negotiation, to allow us to keep the car and recommence payments. They are not accepting Direct Debit due to the agreement being terminated, but allowing Standing Order. My question is that this is an agreement outside the original and with no protection for us, they still retain the ROG order and can implement at any time regardless if we pay or not. Is this legal or should I insist on a formal agreement?

Personally, Rockie, I would ensure that everything is made formal. I would suggest that you perhaps take a look at the CCA1974/2006 and the regulations as the exemptions for consumer agreements are very few and far between.

Of course a lot depends on what you want achieve at the end of the day, but a few bob spent with a lawyer who knows the stuff would not come amiss in my very humble view.
