  • Question regarding the wording of a will

    My Mother died last year and in her will she has made my brother an executor.I have recieved a copy of her will from the solicitor. Her will was written in 2005 and states her address at the time as her house she owned. She sold this property approx twelve months later and bought a flat which she was living in at the time of her death, my brother has been left the majority of her estate except for me getting half any remainder i. e her property.
    My question is as there is a substantial amount of cash left from the sale of her house can i claim half of this amount plus my share that i have in her flat.
    Any help or advice??

    Its hard to advise without seeing a copy of the will.

    You say your brother gets the majority of the estate but then go on to add that you have "half the remainder ie her property." Do you mean you have been left half of the residue or is there a specific devise of the flat? Its not clear.

    I will PM you and then you can send me a scan copy of the will. Obviously take out the names and addresses and the attestation clause etc.

      DS is right - the wording of the clauses is crucial here. You need to provide more detail on this.
