  • Anybody know the answer to this one?

If someone receives a Parking Ticket, then moves house, forgets about the PCN and then bailiffs add a wad of fees after visiting the old address, can the debtor do anything to recover / remove the fees as they went to the wrong address?

Has it actually happened, or is this a hypothetical situation?

I know that many years ago I did this and my husband ended up in the cells as they had issued a warrant to be served on the registered keeper, which they served to the wrong address. When he was pulled over by the police in a random stop - they promptly arrested him and I had to rush to the local court and pay £000's to get him out.... id forgotten about this until reading your post - Can't really understand how he's put up with me for all these years lol Anyway this was mid-80's and Parking enforcement has obviously changed to become Local Authority responsibility - whether the penalty for not paying would be as harsh now IDK. However, I would be careful there are some very harsh and quick penalties incurred under the Local Government Financial regulations - which Im presumming would also now include PCN payments outstanding. The same rules that allow them to make you bankrupt over outstanding Ctax! id get urgent Legal advice!
There are many ways to achieve the same result - careful consideration and planning are the key to getting the result that you want!

That would mean the papers have not been served.
If you have any sort of problems with bailiffs. I can help you as i am a self proclaimed specialist at dealing with them. I am hopefully going to start a degree (law) from october. If you think my posts are helpful or are guiding you in the right direction do show your appreciation by giving me a green blob.
