  • JBW and parking fine

    Hi all,

    My brother has a problem whereas he has today received a hand delivered note through his door from JBW .It is relating to a parking fine for 99 pounds .The bailiff has already added a fee of 200 pounds and is demanding payment . My brother is unemployed and was not aware of the fine .What is his best course of action to take.He is now panicking and worried about leaving his house .

      Caspar am not sure he has just sent me all the letters he has . I will post them on here for you the letter he received from Medway was delivered by the Royal mail in a bag apologising for the problem with the post .This meant he did not get the letter dated 16 April till 2 weeks ago .

          Make sure he keeps that bag from Royal Mail - it could provide very useful evidence. If he's thrown it out, tell him to go foraging! Nice job on a wet afternoon anyway! lol

          The way I'm thinking at the moment, if the delay from Royal Mail hadn't taken place he would presumably have settled the debt within that 6 month period and bailiffs would not have been involved.

          Do try to find out about whther or not it's been to court as this makes a significant difference to bailiff's rights.

            Also looks like it has gone to court as they have a Warrant of Execution for which they have to go to court, I believe.

            The postal delay is really extremely unfortunate. Does anyone on here have a way of pursuing this? Could an application for a stay of execution be entered?

              Surely if it had been to court he would need to have been informed of this .He does still have the bag from royal mail.Is it a good idea to phone the council and inform them of the delay and just to check the Bailliff does not have the right to force entry to his property .Also as he is unemployed can the court can accept a payment .

                You need to file a Statutory Out of Time Declaration and looking at the scans you posted, I believe the forms you will need are the TE7 and TE9.

                  Did you check my link. I couldn't find the bailiff on the register. If he is I missed him hence me asking you to have a look.

                  If he's not on there, then they are being VERY naughty!

                    Hello wahoo thomas

                    Is that Thomas The Tank Engine by any chance?

                    Anyway, that letter from back in April states at the bottom if you can show it was not delivered/served etc, etc.

                    You say you have the evidence from Royal Mail regarding the date of service, so, if you use that evidence you should be able to get them to agree to reduce those added costs, the £75 will then remain as the amount you (sorry, your brother) is liable for.

                    Try and get your brother to speak to them and disclose this indisputable evidence he has in his possession, that should suffice in order to clear things up.

                      Ok just to update .

                      I spoke to the council yesterday (for clarity sake my brother is not very good at speaking with people he gets angry to easy and says the wrong things ) I gave them the PCN number and told them I was Mr XXXXXX whom I am but did not mention my Forename and they where more than happy to discuss the case with me .(Could this be a breach of Data protection ???) .They informed me to speak with Northampton TEC as I was told on the thread .I have since done this and filed an out of time stat declaration . It now lays in the hands of the court and council.

                      Whilst I was doing this for my brother he was receiving several calls from the Bailiff (whom is registered Casper as alexander reid)I had informed him to record all calls which he did.

                      1) He has the Bailiff threatening to break his door down .
                      2) The bailiff is telling him he needs to borrow the money.
                      3)The bailiff asks him what his neighbours would think of this.
                      4)Also after informing the bailiff that all items in the property other than his clothes are the property of his landlord (which he has a full inventory) the bailiff says he will take them anyway and Brother will have to get landlord to get them back.

                      I believe he now has good grounds to file a form 4 complaint but does he need to go through any other channels first to make the complaint.Also if the stat declaration is declined he will still have to deal with the bailiff so should he wait and keep the ammunition he has until he finds the outcome of this .

                          Medway have got it cosy with waller and his bailiffs. Medway will side wioth jbw even if they know they are f*****. I know this from personal experience.
                          If you have any sort of problems with bailiffs. I can help you as i am a self proclaimed specialist at dealing with them.
