    I signed an agreement with a distance learning company called train4trade skills to enrol in a plumbing course and a finance agreement with Barclays partner finance to pay for the course.
    After examining the course material and the structure of the curriculum involved I found that the course I was sold was nothing like the salesman described.
    The main reason I was interested in the course was that I could carry on my current employment whilst fully completing the course except for 11 weeks practical training over 2 years at an approved training centre.
    I have since found that the current NVQ qualification is being scrapped and a new Diploma system is being introduced, where I would have to be employed by a qualified plumber or plumbing contractor for up to a period of three years to complete the diploma.
    On discovering this I wrote a letter to Train4trade explaining that the course was no longer viable for me to complete as I bought it because I could complete it fully at home.I received no reply so I sent a recorded letter cancelling the agreement stating that I had been miss sold the course and want to cancel. I also sent a recorded letter to Barclays Partner finance cancelling the agreement with them. I recieved a a reply from T4TS stating I could not cancel even tho I had cancelled the agreement with Barclays.

    Can anyone help because I feel that T4TS will pursue me for the outstanding course fees. Whats my next move ?

    How was the package sold to you ? Did the salesman visit you, over the phone or did you visit them ?

    How long after siging up for the course and the finance agreement did you cancel ?

    Have Barclays PF accepted your cancellation and confirmed ? and did you make that cancellation within the cancellation period ?

      The salesman visited my home.
      I signed for the course on the 9th august and sent my first letter to T4TS on the 16th August.
      I got no reply so i sent a further letter on the 4th Sept recorded post and at the same time a recorded letter to Barclays.I have received no reply from Barclays. I have phoned on two occasions and they cannaot find the agreement I signed

        I presume, as its a specialised area, you invited the salesman to visit you (as opposed to him just showing up at your door) so have 7 days to cancel and a cancellation notice is deemed served on day of posting.

        You have done everything correctly. There have been quite a lot of posts regarding T4TS and have asked someone who has more experience dealing with them to drop in.

        T4TS presumably havent sent the agreement to BPF as yet. Keep hold of your letters and proof of posting safely as you might need them later.

        What are T4TS saying about the lack of of your right to cancel ? Did you make any payment up front ?

          I paid a £100 deposit at the time of signing.
          The first letter i sent was sent normal post so i have no proof for that one.
          They are saying that I am now outside the cancellation period.

            Okay, when did you receive the claim materials ?

            (just checking that it would scan that you sent cancellation on 16th after reviewing materials)

            You sent the letter on the 16th by first class mail and you have a copy. Are they saying they did not receive that letter and basing it just on the second recorded letter, or are they saying the first letter arrived out of time ?
            Also did you refer to your letter of the 16th in your second letter ?

            Have they written back to you. We can respond quoting the CCA and the cancellation notice service information.

              I have a copy of the first letter I sent on the 16th but i didnt refer to that letter in the second letter i sent by recorded post so i'm assuming they are basing it on the second letter.
              I have been in touch with consumer direct and on their advice i sent a further recorded letter quoting the CCA section 57 about cancelling the credit agreement with Barclays PF.
              What did u mean by checking it would scan ?

                Well you said you read the course materials etc and thats why you decided to cancel as it wasnt suitable for you or as described, so if you wrote on the 16th to that effect you would have to have received the course materials before that date.

                  The course materials were fine,very well laid out but the syllabus is changing greatly and it is not a possible for me to be able to complete the course the way I was told I could.

                    Cool All scans ok then. Have you had response from the letter Consumer Direct said to send as yet ? I'd guess best bet is to give that a few days first.

                    Have you returned the course materials btw ?

                      Yes i have received a reply and that is i quote "We regret we are unable to accept cancellation of your course agreement,either whole or in part,as you are now outside of the standard period allowed for cancellation."

                        Okay, do you have a copy of the agreement you can scan in pls.

                        Also if you can scan in copies of their letters that would be good, and your letters to them.

                        (or type them up)

                        Then we'll reply detailing the 16th August letter and asking again where to send the course materials back to, for a refund of your deposit etc and informing them that you will be entering a moneyclaim at court for return of your deposit in 14 days.

                            Your 1st reply never ever ever ever in a million years get a reply. All letters sent to them before the course is cancelled needs to be send recorded delivery. They can simply say they never get the letter otherwise.

                            How long after signing the contract did you send the recorded letter and how long on the back of the contract does it state the cancellation period is? In most cases it is 7 days. As you were waiting for a reply for the 1st, I assume you missed the deadline?

                            Cancel any standing orders/direct debits to stop them getting payment. While T4TS are known to pursue payments via bailiff threats, they won't amount to anything. Obviously they need court order before bailiffs can do anything and they have never, as far as I am aware, taken anyone to court.

                              How have others fared with a return of their deposit ?

                              I think we'll get in first and sue them for return of the deposit before they get chance to do anything further.
