    Hi everyone,

    Can anyone suggest a good source of ATE.

    The proposed case is unlikely to involve a solicitor for the plaintiff, (though not entirely discounted - maybe on 'no win, no fee' basis)

    I gather that ATE is normally requested by a solicitor, who would advise the insurance co. re % chance of winning, etc.

    Any advice would be greatly appreciated.

      Bit difficult without having any idea what the case is about.

      Why would you need ATE insurance if there are no solicitors involved.

      Apologies i did look at this post yesterday but thought someone who knows more on ATE would answer you, so think maybe we need a little more to go on.

      CMCs are having a nightmare getting ATE for some cases so i dont expect it will be that much simpler for an individual.

      Home insurance often has a legal costs element in I dont know if that covers this kind of thing (well as I dont know what this kind of thing is lol)

        Hi Amethyst,

        ET, construct dismiss, usual basic + general, + breach of contract,etc.

        I haven't yet got permission to post details in public.

        I guessed that it wouldn't be simple, & have no idea what insurance co.'s will require.

        Still, if you don't ask, you don't get!

        Re solicitors - you know that old chestnut 'idiot as a client' - maybe the theory needs testing! (& isn't that what you good people are all about!)

              How far along the Tribunal route has this gone ?

              Legal Aid is available for employment tribunals I think.

                Put in ET1 & accepted by court. (About 1 week)

                No response yet from defendant or ACAS.

                  After the Event insurance tends to only be suitable for employment cases which are not heard in the Employment Tribunal, as costs rarely follow the event. Only in certain circumstances will the tribunal order one side to pay costs to the other. Those circumstances can include if one side has behaved unreasonably in the way they have carried out the case or if a tribunal thinks that a claim was so weak that it should not have been brought.

                      I am expecting the other party to defend the claim quite vigorously, & I'm trying to pre-empt consequences of a part 36 offer rejection should the decision go in the claimant's favour, but the award not as high as anticipated.

                      I am led to believe that, if the decision is given in favour of the claimant, but in the region of the part 36 offer, the claimant has to pay the other party's costs from the date of the offer.

                      If so, those costs could be quite high, probably as much or more than the award for damages.

                      I'm just looking to cover all bases, & your advice is greatly appreciated.
