The Torquay and Newton Abbot Court have today informed a claimant that the stay imposed on her claim for a return of unfair charges against Natwest Bank Plc has been overturned.
The Judge originally stayed the claim pending the ultimate determination of Commercial Court Litigation brought by the Office of Fair Trading and the Financial Services Authority.
The Claimant, with the help of the team at LegalBeagles.info, submitted an application to the court to overturn the Stay to allow her claim to continue without further delay.
The application to remove the stay concentrated on the Tax Credit Act 2002 Part 2 Section 45 and the Social Security Administration Act 1992 (s.187), and highlighted the claimants specific circumstances and the detrimental effect having to wait for the outcome of the test case would have on her and her family.
