    Good afternoon , I am feeling a lot better today, possibly bacause of the positive action I have been taking, not only in regard to my debts, though probably primarily so.

    Now to my HFC problem which would seem, on the face of it, a pretty straightforward case of, "I owe the money". I paid some back but, because I did not keep a record, I have no idea of exactly just how much. The paper trial I have starts at the begining of January 2007 with a letter from HFC asking for full and final settlement within 7 days, or their Litigation Department would be "commencing legal proceedings or instructing an external DCA".

    As it happens, and I think this may prove important, I had sent HFC a declaration of my incoming and outgoing which demonstrated my inability to keep to the agreed repayments some months prior to the above action. A letter explaining why and offering an alternative, but substantially reduced monthly repayment, and the said declaration were studiously ignored.

    As soon as I stopped the DD, which I had told them I would HAVE to, and the account went into arrears, they passed the debt to Lewis Debt Recovery. They sent a Final Demand dated 3rd of March 2007 and another on the 27th ( I had failed to notice at that time, that the final demands were for 2 seperate amounts). LDR were so transparently stupid I got rid of them with one well worded letter.

    The rest of 2007 went as follows..... In March I am informed by 1st Credit (Finance), that they have been assigned the full outstanding balance, and they want it NOW. There was the usual opening barrage of threats with, interestingly, this paragraph tacked on at the end as though it had just ocurred to them that I might question their right to demand this money.

    "In accordance with the Data Protection Act 1998 we will comply with any request for a copy of the Personal Information about you that is held on our computer system. Send your request, along with the administration fee of 5.00GBP and a sae to the above address"

    Oh that I knew then what I know now!!!

    Nothing much is heard from them until 14th September 2007, when I receive an identical letter to the one I got in March except it has a different ref number and the amount is, wait for it, 14.63GBP greater!! It is only after looking at all the other correspondence relating to HFC that I now see I seem to owe two seperate amounts on two seperate a/cs. I have now seperated the two sets of letters and will have to have 2 threads for HFC. This one for the 881.47, and another for the 896.10. Is that OK?

    Connaught Collections UK Ltd., and Mackenzie hall have both been threatening on both a/cs at various times in between. I wrote letters to them both, expressing my confusion and so far, in regards to the 881.47GBP a/c I had the "Doorstep" letter on 17th of Feb this year, which I now know how to deal with and will do so forthwith. (I have a form 6.1 relating to this a/c which I think means I am a bankrupt. It is dated 11th November 2008).

    That is how things stand at present with a/c 881.47

    Ok, the main advise I have is that when dealing with 1st credit, you should make sure everything is in writing.

    Are both accounts the same debt? That's naughty.

      That is one thing that is not exactly clear to me. I have a sneaking suspicion that one is a bank loan that I used to buy a computer system, in November 2003, and the other is a credit card which they just sent through the post to me (Bubbles or something daft). I certainly do not think they would have given me a card with a limit of over 800GBP so soon after lending me 1200GBP to buy the pc from PC World, do you?

      I do not deny borrowing from them and starting to pay back as per agreement, I just had to renege because I could no longer afford to continue after my accident. I did offer to pay a lesser monthly amount over a longer period and they ignored me. It is the sudden and unheralded arrival of the second "Final Demand" that has thrown me, since I had no knowledge of my paying off two seperate debts. :suspicious:

      I will deal with the 'doorstep' nonsense from ScotCall and then SAR 1st Credit regarding both claims, since they twice. Jee, that will be more than 5 quid!! I am not sure I can afford that much in one go :faint:

        Don't waste your money S.A.R.ing first credit, that's a waste of time - they have no info of interest. It's sometimes worth S.A.R.ing an original creditor, since you can learn interesting things (like any charges etc).

        If you don't know what the debt relates to, I'd send a simple "prove it" letter to them asking what the debt relates to. There's a template somewhere (CB will have it)

            Interesting stuff here.
            Well the fact one has been passed to Muckie Hall speaks volumes are they specialise in the unenforceable and uncollectable !!!
            Scotcall are the most likely of any DCA to send and agent, in fact I believe that's their main business, so send them the No Vists letter from you other thread.

            I agree with Tom that to SAR a DCA is a pointless exercise, but I would send a FULL SAR to HFC for everything that they hold on you.

            As for a Prove It letter for 1st Crud there's a good one here: CB Vs Thames Credit aka A Case Study - Legal Beagles

              Thank you CB. I will do that this morning.

              I now know that on the 28th Nov 2003 I got finance from HFC for a computer and accessories. In total I paid PC World £1003.96 because I opted for the 5 year Coverplan for the m/c (£285.00), and the monitor (£69.00), which turned out to be probably the very best thing I ever chose to do, because as a result, the pc still works as good as new and the monitor was changed for the 3rd time only 4 months ago...Anyway, on the same day it seems I signed an agreement for a CC (Marbles, not Bubbles, as previously thought, though I did say it was something crazy..:crazy, but at the time I had no idea what a credit card was, so I can only surmise that it was because I had a good credit rating that I got so many other CCs!!!

              Looking at the agreements, I think I am well 'stitched up', as they say, but then, I have never denied that I owe money to HFC, I only question the amounts, and the integrity of the people trying to recover it. I am also now concerned that PPI was added on without my knowledge because, obviously, had I been aware that such insurance was in place, I would have claimed immediately following my incapictating accident in Dec 2005.


              Because there are no recognizable Ref numbers on the original agreements that I can directly relate to the other paperwork I have, I do not know which is the Marbles card and which is the pc. Do you perhaps think that I should try to get this information from HFC now so that we will then be able to name the HFC threads accordingly? Quite frankly, I am finding this all very confusing. (Wait until you see what I have to say regarding Capital One!!).

              Anyway, as of now, this thread is at the, 'warn off ScotCall' stage. I have yet to start the HFC 896.10 thread, but will do it directly following the writing of the ScotCall letter.

                In all honesty I would simply send Snotcall a NO Vists letter and then a FULL SAR to HFC and see what turns up.
                I think it would be best to keeps both HFC actions in one place as they are heavily linked.

                Once you have binned Snotcall, any DCA that comes sniffing, send them a Prove It letter for openers and we'll go from there.

                  Gemini - was the "doorstep letter" a Statutory Demand?

                    Well spotted Birdie, I have only just noticed that as well.
                    That'll teach me for having the weekend off.

                    In all honesty if the 6.1 was dated Nov 08 and you haven't heard anything since, you have lucked out and Connaughts haven't taken it further.

                    Statutory Demands and NOT to be ignored, EVER !!!
                    Even if they are simply a threat or incorrectly served, they are the first step to Bankruptcy and serious issues..

                      For the sake of clarity.. I am in receipt of an SD Form 6.1 but I made a mistake with the date on the document (humble apologies). It is actually 11th August 2008. My eyes were on the way out from constantly checking dates in all their various formats. It was filed (?) by a Mr., Blah blah on behalf of Connaught Collections UK Ltd.
                      Original creditor: Hfc (sic)
                      Assignees: 1st Credit (finance) Limited.

                      I totally ignored it when it hit the mat because, to be sure, I have nothing of value other than my two old Samoyeds bitches (worth a pretty packet in monetary terms when new, but only of emotional value now - priceless!! ), so bankruptcy holds no fears for me. My creditors know this, because I wrote and told them so several years ago. Nothing much has changed since.

                      The above relates to HFC 881.47 and the latest 'Doorstep' is from ScotCall, with the usual 7 days warning, and is dated 17th February 2009.

                      As for the HFC 896.10, I have just written a 'Prove it' to Mackenzie hall, along with a copy of the latest letter I have from them, which is an offer of an acceptable (for HFC), final settlement (716.88), dated 26th September 2008. I pointed out that this was the latest correpondence I had from them and the reasons for this was none of their concern. I therefore offered no apologies.

                      So, do I continue with the "No VISITS" to ScotCall and the full SAR to HFC?

                        DON'T bother writing to Mucky Hall, you can happily ignore them PERMANENTLY
                        They are the biggest joke in DCAland.

                        Yep No Vist to Snot and FULL SAR to HFC.
                        You want everything that HFC hold on you.

                              Sorry if I seem a little dense here, But since 1st Credit have actually purchased the debts from HFC, should I not be SAR'ing them, rather then HFC in the first instance?
