  • Voluntary Termination

    My Nissan vehicle was due to be picked up last Wednesday but the driver refused to take the car on the basis he felt one tyre was illegal, even though the garage had said it was ok. Can they charge me for coming back next week? Also, when I asked to terminate I was told we had to pay just over £600 to reach the stage whereby we could terminate. We sent the termination for in but had not yet paid the £600. We then changed our minds about terminating but were told we then had no choice as the contract was terminated. Is this right please?

    they did not take a payment in December. Once terminated, will the debt fall off our credit file? We were told it wouldn't until the balance plus excess mileage charge and any extras they would charge are paid in full.

    sorry for asking so many questions but we are worried about how much the final bill will be and when exactly will the debt be iff our file as we need to apply for a mortgage.

      What you have been told is correct. Just like any other arrangement if you terminate the agreement then it no longer exists - it's not something you can waive around willy-nilly and then change your mind because you don't like the circumstances. This is why you need to make sure you understand the repercussions before actually going ahead.

      There is one way of avoiding termination of the agreement but it requires two things: (1) the termination date has not passed, and (2) the lender would have to consent to the termination being revoked.

        Hi Kati,

        Our car was returned last month. We have received a bill for the excess mileage, damages which were scratches on the alloys which I feel is wear and tear as we had the car for two years. Also charges for an aborted inspection charge. The total is £1760, which included £649 VT shortfall.

        We were led to believe by the salesman that the mileage would not be an issue and was a guide only. We told him we anticipated travelling up to 15,000 a year but he said 10,000 would be more than enough to declare as most people over estimated. We had the tyres checked before collection and were told they were all legal. However, the driver refused to take the car away on the day as he felt one was illegal. He offered me 15 min to sort it all out which clearly wasn't enough time which is why have now billed me for the aborted inspection charge.

        We returned the car due to financial strain. Its showing on my credit file as contract terminated and closed account even though the VT shortfall is outstanding.

        please can you tell me where we stand with all these charges. We don't want a bad credit file which is why returned the vehicle.
