    Hi my partner is contracted to 40 hours in his job with half hour unpaid breaks a day. He normally works 830-430 which works out at 8 hours a day so 7.5 with his break so over his working week he’s only working/being paid for 37.5 this surely cant be legal? If anyone could spread any light on this please thank u in advance

    is the work over 5 days (Mon - Fri) or 7? 7.5hrs a day over 5 days works out as 37.5hrs a week (40hrs - 2.5hrs unpaid breaks), but I suppose it will all boil down to the wording of his contract.

      Hey yes it’s over 5 days I just presumed he would automatically work
      40
      hours plus his 2.5 unpaid =42.5 I need to double check his contract though
      when I had a 40 hour contract I worked 45 hours a week
      n had 1hr a day break=45 hours a week 40
      paid I just presumed would be the same

        As [MENTION=49370]Kati[/MENTION] has said I would need you to post up a copy (redacted if need be for company name and partner's name) of the exact clause in regard to your partner's hours of work.

        For example I often see clauses such as your hours of work are 9.00 am to 5.30 pm, Monday toFriday with a one-hour lunch break which equates to a 37.5 hour working week. Effectively the person is "around work" for 42.5 hours a week but annual salary is based on the 37.5 hour working week.
