  • Statute barred debt and credit file question.

    Hi. Someone I know is soon going to be paying a reduced, full and final settlement on a statute barred debt. The payment is being made to a DCA and this debt is, obviously, currently not showing on their credit file.

    The DCA wouldn't now make a new entry on their credit file, showing the debt as 'partially settled', after they receive payment would they? The person concerned naturally doesn't want this debt showing on their credit file for yet another 6 years, as 'partially settled' still isn't a good thing to be seen there. Thank you.

    Why are they making a partial settlement on a SB debt?

    As for the report, it should not reappear.

    Is you friend absolutely sure it is SB with no payment or acknowledgment for a clear 6 years - 5 in Scotland

      Hi warwick65. Thank you very much for your feedback. Yes, it is definitely a statute barred debt. I think that the person concerned is just seeking to pay it off for peace of mind. Each to their own and I certainly don't judge anyone else on how they approach things.

      P..S. Do you possibly have any opinion to offer on the other thread I started yesterday? No firm conclusions have yet been reached and I wanted to file my claim before Christmas.

          I just wanted to say that, soon after I started this thread, someone else in my household started to re-get phone calls form a notorious DCA about a very old statute barred debt. Moreover, they hadn't heard from this DCA in a very long time either. They didn't answer the phone, but they knew the number off by heart from past experience.

          If this DCA did phone up because of this thread, as they do likely know who I am and where I live, then do please listen. The person I was asking about in this thread is not the person you phoned up, so I am sorry if you got excited and your hopes were raised. Much appreciated.

            I am sure I started this thread in another forum. Almost certainly the 'General Legal Issues' forum from memory. How did it get into the 'Welcome forum' forum? I just had the same experience on another thread I started, which now means I am feeling even more confused. Is someone trying to make me feel extra 'welcome' or something? Ha ha ha.
