  • Nolans solicitors

Please could everyone be made aware that the above company seem to be on a crusade of pursing very old debts. These debts are statute barred and I would recommend anyone to furnish themselves with the facts about statute barred debts. It is illegal to pursue statute barred debt.

I have reported one case already to the SLCC (Scottish Legal Complaints Commission) however another case has just raised its head today. A case where the account has been statute barred since February 2014.

I can imagine Nolan will claim that they are just acting on behalf of their clients however I do not believe for a minute that it extinguishes their responsibilities. They surely must perform some diligence ?

I'm not sure it is illegal to chase statute barred debt. It is against FCA rules https://www.handbook.fca.org.uk/handbook/CONC/7/15.html but not a criminal offence, and indeed that would be Nolan's clients ( the owners of the debts)

Also remember if they brought court action before the 5 years ( in Scotland https://www.legislation.gov.uk/ukpga/1973/52/contents ) was up it puts a stop on the clock.

and indeed that would be Nolan's clients ( the owners of the debts) - so Nolans do not have to perform any due diligence to the case in question?

I take on board what you said about the legality aspect, however the FCA guidelines are there for a good reason. Companies have to tow the line otherwise they get their licenses revoked to practice (well, hopefully). I would also like to believe the FCA are also there to protect the public.

I can stand up for myself, but there are loads of people out there who are far more vulnerable than me and if a solicitors letter tells them to jump, they just ask how high?!

PEOPLE, DO NOT BE INTIMIDATED !!!!

Ame, I know you are familiar with one of my cases, however this particular one that has just raised its head (for a credit card) was last acknowledged at the beginning of 2009! No court case has ever been raised so there is no question of it being statute barred. Not after almost 9 years lol x
