  • Help Required Please - Solicitor threatening CCJ for unpaid PCN

    Hi,
    In May 2016 the driver parked in a local private carpark, paid for and displayed the ticket, and did not exceed the time they had paid for.
    In August 2016 I received a PCN for £150 due an ‘expired or invalid ticket’.
    I contacted the company to discuss and provided a copy of my ticket (which I still have). The response was that the ticket was ‘expired or invalid’ but no further detail would be provided upon request. I assume the problem is that my VRN is not displayed on the ticket, although I entered it into the machine. The driver did not realise this at the time as they didn’t see it necessary to check if the machine had printed the ticket correctly.

    I have received 4 further letters, from various debt collection companies, all requesting various amounts. The latest letter is from a Solicitor demanding £208.00, which, if unpaid, will result in a CCJ request and possible intervention from a bailiff.
    I genuinely feel as though I’ve beeen harassed and bullied over this, for over a year, although I have done nothing wrong.
    Can somebody please help? I don’t know what to do, but will not pay the £208.00 out of principle. They bought and displayed the ticket and did not overstay.

    Hi, welcome to LB.

    A few questions, if I may.
    Do you live in England/Wales?
    Is the vehicle privately owned/registered? Or HP or similar?
    Was there a windscreen PCN? If so, do you still have it?
    Do you have the first postal Notice?
    Did you take pics of any site signage?

      I live in England.
      The vehicle is owned & registered to me.
      There was no windscreen PCN.
      I do not have the first postal notice - although I do have all subsequent notices/letters from debt recovery companies.
      I have taken pics of site signage.

                  This particular letter is just a debt collection letter, & so can be filed & ignored for now. (The clue being ..."may result in us recommending..." etc).
                  If you receive a 'Letter Before Claim' or a court claim, they require a response.

                  On to more pertinent stuff.
                  It is unlikely that the notice you received in August was the original Notice to Keeper.
                  You should have received that within 14 days of the parking event & it should have shown a £100 charge, with the option of paying the reduced amount if paid promptly.
                  A big question.....when you contacted the parking co, did you ID who was the driver at the time of the parking event?

                        Hi, I requested a copy of the original postal notice on 16th December, but no
                        response received. The company only provides a postal address on their website, no phone number or email address. Any advice would be much appreciated. Thanks.
