  • Is this enforceable????

    I've got a court date for next week for a very old Catalogue Debt.

    The last payment was in April 2011 and Lowell who are chasing the debt are unable to provide any evidence of a credit agreement.

    My question is, is this enforceable??

    Have you exchanged witness statements as yet, and were there no copies of documents in the exhibits ?

    Have you sent a CCA request, and have you said in your defence that you have sent a CCA request and they have failed to comply?

    Had a quick look at your other threads, not sure exactly which this is or what you have done to date, so really need some more information to have any idea at all as to the answer to your question.

      I did the CCA request and did not receive any response just the standard we are trying to find this for you.

      They have sent there witness state to the Court, but there is no copy or evidence of any signed agreement.

      Lowells are the DCA.
