  • Advice on Nasty situation

    My work friend is in turmoil and is trying to find the best way to sort this. He is in pieces and we know he needs to get professional help. He just needs some gentle guidance until he can call his lawyer.

    OK be as simple as I can
    The man is father to 2 children. he split from the mother and divorce. Both moved on. But mother denied access to the children, accused him of rape and lied to everyone that he was not allowed to see children due to court order (was untrue and father never advised to stay away)

    In Sept the mother fled her partner after an incident at their home where the police were called. ( a partner known to do drugs, be violent and was accused of rape himself with the case actually making the news!!!!) - The children were taken to her family while she was helping the police that day. Now she contacted the father and his family to allow access and she told loads of people she was scared of the man, feared he would kill her, knew she was controlled by him, was beaten by him, wanted the best for her kids etc etc.

    The father and family are aware of a time when this man stepped on the 4 year olds hand and broke fingers and has possibly caused a deep gash on his head. He is banned from seeing his own kids due to violence to them. Children have also been hit by this man (both children told a family member), their clothes do not fit them, they only eat junk food with the 4 year old not knowing what a chicken or plate of vegetables look like. A lot of neglect and abuse father is aware of through observations, knowledge and the children themselves (the eldest was withdrawn and quiet for a while)

    It was believed the mother was heading back to this man. It was confirmed today when she was witnessed with him and revealed the 4 year old has told his dad the mother was once more talking to this man.
    So basically this violent man is back in the lives of the 2 children he has beaten. Today the mother once more told the father to never contact her (or she would do him for harrasement)
    This man and the mother are already in trouble with the Police and 2 areas of Social Service due to everything thats been happening with them. The mother is even known by name to a lot of poilice officers due to her constant contact with him

    Now a load of us at work have been telling this father that once he starts court proceedings that the court will see all the bad mother has done, been around etc and hopefully will see the children are in a violent situation. (Father has a lot of evidence to back this up along with the police reports and previous SS reports)
    However the father is determined he will lose the kids to this violent man and his ways.

    What can people advise.

      Good morning,

      As you say a nasty situation.

      My feeling is your friend should not be waiting to see a solicitor but should speed up the process now.

      This seems to be a very complicated scenario, not one I would feel easy about advising on, but I will alert others for help.

        His solicitor will help him with his application to the courts for child arrangements. This might help some set his mind at ease - https://www.cafcass.gov.uk/about-caf...eparation.aspx - it is likely the court will want CAFCASS involved. [MENTION=85489]FionaC[/MENTION]

          Thanks. Thats very helpful. Might set his mind at ease. He is off to see lawyer tomorrow.
