Re: CEL Ltd parking fine whilst working at Oldham hospital.

This is the email/letter i will send to CEL. Any advice is greatly appreciated on this.

    Good morning

I am emailing regarding PCN ***********

Yesterday the registered keeper received a letter saying the outstanding debt is now £110, they have yet to receive a letter telling them they had a debt and apart from a ticket which they believed was dealt with this is all they have had.

In mitigation to the charge and the reasons they feel they would like the ticket cancelled are as follows:

    1. The driver is a current serving prison officer employed by HMP ******* (they can not provide id number or prisoners details as per OSA and to do so or ask to do so is a crime) and was working at Royal Oldham Hospital on ********** on an approved bed guard. The driver was instructed by hospital staff to provide details of the vehicle so to stop any charges as they are exempt from parking charges also they were working on ward T2 which carries an exemption from charges. The driver provided details to hospital staff and was then handcuffed to the prisoner and unable to move for the shift. Hospital staff informed the driver that if he does receive a ticket to contact the hospital again it will be dealt with, he did this and believed that was the end of it.

    2. The drivers colleague who they were working with received a ticket and contacted you directly and had the ticket erased so the driver is asking the same treatment.

    3. The driver arrived at 05:25 and the signage was unclear due to being dark.

    4. The driver believes that correspondence should have arrived within 28 days, allowing them time to appeal, as this has not happened they believe the ticket should be dismissed.

    5. The driver understands the need for people to be ticketed but on this occasion believes the fact that they were there to protect members of staff and public from said prisoner that they meet valid mitigation to have the ticket dismissed.

    Kind regards
    Registered Keeper

I would recommend holding off on sending any thing until ostell or charitynjw have given their thoughts...there's not dire urgency to get this out to them...

Apart from that would you recommend sending this?

Re: CEL Ltd parking fine whilst working at Oldham hospital.

In any conversation with parking companies and their solicitors you ALWAYS talk as the keeper. It was the keeper that received that letter, they got the registered keeper's address from the DVLA. The keeper is not a defendant, simply trying to sort out a ticket received by the driver of his vehicle, a driver who they do not know and would love to get details.

So let's have some dates. What date was the alleged breach, what date was the Notice to Keeper received?

The alleged breach was 19th August 2017 and the NTK was received on 16-11-2017. The keepers wife believes she may have thrown a letter in the past from them in the bin.

Re: CEL Ltd parking fine whilst working at Oldham hospital.

After a windscreen ticket the NTK needs to be delivered to the keeper between day 28 and 56 after the event to be able to hold the keeper liable. If that was the date the NTK was received then they are unable to hold the keeper liable and can only go after the driver, who they do not know and there is absolutely no legal requirement for the keeper to provide that information. Please confirm the dates. If true then a BOGOFF letter is suitable.

Go back through all your posts and edit anything that gives the slightest hint on who the driver could be. They do read these forums.

There can only be a CCJ against you IF your are taken to court and IF you lose then fail to pay within a month. Until such time as you have lost and not paid then they cannot send in bailiffs to seize goods and they have to give notice of a visit.
