I'll take a good read through in a short while. (Hope to post back here before the LB site closes for maintenance later today.)

Before we go any further, your defence mentions inadequate & poorly lit site signage.
Have you actual proof of this?
Or are you relying on the driver's memory of the event....from 2.5 years ago.......?

@charitynjw

To be honest yes that is from memory - we don't have pictures of the signage, should I remove this part from the statement?

@charitynjw Well as you expected there has been no response as yet from CEL - I can see from the recorded stamp they received my communication Wednesday morning.

Apologies as the time is drawing nearer im getting more nervous.. Regarding the mention of the signage in my defense, in your opinion should i remove that statement as it is from memory?

Also does the rest of the statement seem ok to you?

The alleged contravention occurred at 8:20 on an April evening....it would have been dark then.
The Claimant has not yet provided any evidence that signage was adequately illuminated.

I've made some suggestions.
But I cant seem to upload the file.
Kati....is there a problem with .docx files?
(Good afternoon btw )

From what I've seen lately, CEL scuttle away when faced with even a half-decent defence.
