    Default Private Parking Charge

    Hi i parked in Manchester at Xtra parking owned by UKCPS and i payed and displayed but still got a PCN. I drive VW Touran as a taxi and UKCPS are saying taxi's are commercial cars so should have payed double. So i went to see the sighns and it says Vans Minibuses commercials pay extra.so can anyone help me find out if taxi cars are commercial. Thanks.

    · A Taxi is classified for type approval as an M1 vehicle so it is

    not classified as a commercial vehicle, a taxi has an excise licence or
    Vehicle Tax Class of Private Light Goods, Petrol Car or Diesel Car
    dependent on age and/or make model.

    Hi thanks for replying. I am confused because i searched the internet and some people say if a car is used for business and to make profit then its a commercial car. And also UKCPS saying minivans pay extra aswell now i found out minivan is a American word for MPV and my car is a VW Touran MPV. But on the sign it says Vans not minivans i have photo of the sign. Do you think i should pay £60 charge or do i have a good chance of winning thanks.

    So if there is a lack of clarity or if there is any ambiguity the wording of any contract is construed contra proferentem ie interpreted against the draughtsman.

    Also they are changing their mind as to what section you are alleged to have breached.

    Could you post up the PCN,first removing identifying details?
    Have you been in touch with UKCPS, and if yes did you name or admit to being the driver?

    I can't read the UKCPC sign.

    But Xtra no longer exist.

    As i am 100% sure i displayed my ticket the only thing they can say is a taxi is a commercial or a minivan but the word minivan is not on the sign it just says vans. Thats why i need to be sure taxi is not a commercial car some people say if its used for business or for making profit then its classed as commercial. And if Xtra Parking is dissolved do UKCPS have wright to issue PCN's.

    Whether "car" or "van" here's another definition from HMRC (https://www.gov.uk/hmrc-internal-man...anual/eim23110)

    Section 115(1) Income Tax (Earnings and Pensions) Act 2003 (ITEPA). This works by exception: every mechanically propelled road vehicle is a “car” unless it is

    • (i) a goods vehicle (a vehicle of a construction primarily suited for the conveyance of goods or burden of any description),
    • (ii) a motor cycle (as defined in Section 185 Road Traffic Act 1988),
    • (iii) an invalid carriage (also as defined in that Act), or
    • (iv) a vehicle of a type not commonly used as a private vehicle and unsuitable to be so used.


    If the draughter uses terms which are ambiguous, that is their problem.
    they needed to define on the sign what they meant by a "van" and by "commercial vehicle"
    eg EC Council Directive 68/297, substituted by EC Council Directive 85/347 defines "commercial motor vehicle" as any motorised road vehicle, that by its type of construction and equipment is designed for, and capable of transporting, whether for payment or not: (1) more than nine persons, including the driver; (2) goods and "standard fuel tanks".
