  • MET Parking Charge

    Hi there. Seeking some advise please on a recently received PCN from MET Parking Services.

    As registered keeper I have attached a copy of the detail and request received. The driver advises that the lighting was poor and that no sign or notice was seen as you may realise from the dark images captured.

    Furthermore I note that the zoomed image of the registration number on exit is not the yellow numberplate captured from the vehicle itself, but a white digitised copy. Is this valid?

    Any help you can offer is much appreciated. Thanks

    Hi & welcome to LB.

    Have you contacted McD's?
    I believe this is a 24hr one?
    & probably not that busy at that time of night; if so, it's not as if you were stopping others from parking in the early hours of a Sunday night.

      Thanks for the welcome.

      I have indeed contacted MacDonalds and the on-duty manager has offered to drop me an email of support. I'm advised that the parking charges were introduced to deter people from a nearby car auction using the site for parking, and not it's customers. That is a 24 hour restaurant and you are correct that the driver advises that it was an almost empty car park at that time. However I'm worried this may not be sufficient to argue the case.

        You won't need to argue a case if McD's intervene.

        & your case can clearly be distinguished from the ParkingEye v Beavis case (the argument there was largely commercial justification to stop people taking up available spaces during opening hours in a retail park).
        I wouldn't think that there are many auctions at that time of night.

          So despite a supporting email from McDonalds, I've had my response from MET and they have rejected the appeal claim of the driver. Please see attached documents.

          Furthermore they make assumptions in their latest correspondence that I personally was the driver, I quote…

          “We note that you were a genuine customer however…”

          Continuing to add that they had contacted McDonalds to confirm ‘my’ version of events. I would like to challenge them to understand how they are able to determine which customer was the driver of the vehicle?

          Grateful if you can please advise what next steps I should take. Do I revert to MET to further challenge or do I have to go to POPLA?...and if so what do I say?

                You go to POPLA to appeal. Search in other threads for suitable appeal texts. You must include the fact that McD (the principal ) have requested that the ticket be cancelled by their contractor.
