    Hi

    Wondering who I can report a company to when they force a 17yr old to work over 8hr shift? She is employed for 4hr shifts but they are actually until they are told they can finish which is now up to 9.5hrs. I believe she should only be doing a maximum of 8hrs and next week they are expecting 7am to 10pm. This is becoming difficult as she says having no end time that makes a shift feel continuous. She is at school studying A levels 5 days a week and weekends being forced to work over 16hrs...it's too much

    It is so hard for young people to get a job nowadays and she works so hard I want to report the issue so she doesn't lose her job but hopefully will be treated more fairly.

    Hours of work and rest breaks

    16 – 18 year olds

    If you are over school leaving age (see under heading General rules on employment) and under 18, the law says that you must not work more than eight hours a day, or more than 40 hours a week. You must have twelve hours' rest between each working day, and 48 hours' rest per working week. You are also entitled to a 30-minute rest break when you work for longer than four and a half hours. There are some exceptions to this (see below).

    There are special limits on the hours you can work at night. You cannot usually work between 10pm and 6am. If you are contracted to work after 10pm, you must stop work at 11pm and not start again before 7am. There are some exceptions for young people who work in hospitals, agriculture, retail, hotels and catering, bakeries, post/newspaper deliveries, or in connection with cultural, artistic, sporting or advertising activities. You are not allowed to work between midnight and 4am, except in the most exceptional circumstances.


    The rules about working at night do not apply when:-

    • your employer needs you to work to maintain continuity of service or production, or to respond to a sudden rush in demand; and
    • doing the work would not affect your education or training; and
    • no adult is available to do the work; and
    • you are supervised by an adult (if this is necessary for your protection) and you are allowed a period of rest as compensation.

    If you are allowed to work at night, you must first be given a free assessment of your health and ability to do the work. The assessment should be repeated at regular intervals.

    You must not work more than eight hours in a 24 hour period.
    Debt is like any other trap, easy enough to get into, but hard enough to get out of.

    It doesn't matter where your journey begins, so long as you begin it...

      I know she shouldn't work over 8hrs but how can we get them to stick to the law? I feel if she brings it up at work she'll be given no shifts at all. Surely there is someone who would check they are following certain rules

        CATCH22 here refuse work no job and someone of same age may well do the hours instead

                    Just an update...I reported this to the local council who did nothing. She had been doing a lot of hrs up till Christmas and after it died down again until today. They are supposed to have 3 weeks notice for stock take and they were given a week and still they expected her to work 5hrs from 7am and then be back at 4pm to work until finished often early hrs. She did not go back so I expect no job next week...This company should be fined and forced to follow the law.
