  • Neighbours mains water supply and sewer leaking under my foundations

    I live in a two bedroomd semi detached property and my party wall is shared with the neighbours who have a three bedroom property with a downstairs toilet, property was built approximately mid 1980s south west uk block built cavity walls.

    TWO ISSUES
    1 Sewer gas odor back drafting around my property
    2 Water ingress from under the front of my home
    ISSUE 1
    SEWER GAS BACK DRAFTING
    Next door neighbours sewer line is 12 inches from the foundations of my house.

    Mine is on the other side of my house.
    There is a ( 1 of 6 identical around my property) 10 inch Hepworth inspection sewer manhole, which I must add is the only one that has no screws in it and can be inspected where as the remaining other 5 have been ignored and brushed aside, nobody could open them I am of the understanding that they are there for the purpose of inspecting. I have no idea which lid is for foul water or grey water. I also understand that these manholes should be inspected on a regular basis what is the point of having them if nobody is prepared to have a look and rejected by South West Water and an RICS inspector environmental health and someone from one of the largest leak finding companies in the UK?
    From the day I moved here 20 years ago there has been an awful smell. Believe me when I say it's a long story and I have tried everything this is why I'm writing this now as I'm at my wits end, my health and my home are declining and I need help as soon as possible please. So it is taking me a long expensive path to get to where I am now. It's recently that I've tracked it down so I am trying to express it in the easiest way I know possible.
    The disgusting sewer gas odor that permeates my house & wafts around every single corner of it. It's APPARENT WHENEVER THEY USE ANY OF THE PLUMBED UTILITIES IN THEIR HOUSE, I don't know which part of their plumbing all I know is when they are at home it causes this sewer in to my house and it stinks. When they are not home the smell is hardly there, in fact when I have my music playing and I don't know if they're home as I can't hear them BUT I do know they are home because the sewer smell wreaks and wafts its foul stench around my home! So I go to the window and look out I I see one of their cars ,or the the back doors open so they let the dogs out.

    ISSUE 2
    The water ingress
    Much to my dismay I discovered that the mains water supply pipe to my next door neighbours run from the other side of my drive under my front garden under my front porch foundations to promptly enter their property at our party wall where it connects to their downstairs toilet, above which is their bathroom & toilet and then back downstairs to continue the length of the party wall to the other end of the property to their kitchen.
    The next point to note is the party wall is always FREEZING cold to the touch and this is all year round.
    Does this have anything to do with the fact that their mains water supply pipe enters their property at our party wall and that any leakage from that could be sucked into the breeze block also their water pipes being in this wall I can see no other reason as my water pipes are on the other side of my house which is where my garage is.
    I have two windows at the front of my property one for the kitchen and above it one for my spare room they are both uPVC double glazed.
    On days when it's very sunny weather, no matter if it's freezing cold or boiling hot, summer, winter etc both the windows at the front of my property become heavily covered in water in side the sealed unit between the two panes of glass.
    A great example of this, which I have photos of, is the August bank holiday which was a hot sunny weekend.

    Upon returning to my home Sunday evening was it was still sunny, to my horror I could hardly see through my kitchen windows as they were full of water however after 14 hours over drizzly damp night when I went downstairs in the morning my windows were clear, totally clear.

    This only ever happens to these two front windows. All the other windows on my home do not have this problem and I never have condesation on ANY of my windows at any time.

    After much reading online I discover to my horror that water pipes are not permitted in party walls!? On top of that I then find out that as these where built in the mid 1980's and back then the pipes would NOT have been sheathed. Makes sense as the builders of these homes where bad at their job! To back this up further, a few years back, surprise surprise, next doors downstairs wc had a water leak. I had already mentioned mold growing on my side of the party wall opposite their wc but they brushed me off. The leak was a pinhole in a copper pipe SET IN CONCRETE IN THE WC FLOOR which is where their main water supply enters their property. THEY HAD IT REPAIRED. CLEARLY IT NEVER CROSSED THEIR MINDS OR THE PLUMBER THAT THIS WOULD ALTER THE PRESSURES ON THE REST OF THE COPPER PIPE AND INEVITABLY CAUSE MORE HOLES?! I despair.
    So my questions about this are, does anyone know what the party wall act has to say about water pipes in walls? Is there anything that can be done to see if the neighbours water pipes have to be either re positioned or sheathed.

    I store my clothes in my wardrobe (I took the doors off years ago and just have a length of fabric hanging in their place) and drawers and naturally these are against the party wall as one would believe this to be the warmer wall of the four walls of a house the other three being exposed to the elements.
    I have photos to try and show the disgusting mess that becomes of my clothes in a few weeks of being cleaned.

    This goes on all year long hot or cold makes no difference my clothes have a white powdery moldy growth on them, there's no odor but it's just disgusting and exhausting continually washing clothes they're getting worn out (as am I) before I even get a chance to wear them in fact I'm so put off even looking at my clothes half the time because every time I do I find more white powdery mildew growing on everything, my heart feels like lead and sinks every time.

    Also I have to have containers full of these things called Kontrol Krystals which basically collect moisture. I have one in every single drawer I have three massive ones in my wardrobe I have them under my bed under my dressing table I've got them inside my lounge around my electronic equipment everywhere, in a cabinet, on shelves on the party wall and I have to keep changing them every two weeks because they're full of water.

    I used to have my dehumidifyer in my bedroom and it made no difference when using the krystals to soak up moisture in the drawers. This happens in the summer and the winter and it makes no difference if there's a drought or a monsoon, it makes no difference.

    I have a dehumidifier on 24 /7 which I did have upstairs for years but that has changed now. I have it in the porch where the neighbours mains water supply pipe runs under the foundations of my porch, which is next to my kitchen which is underneath my spare bedroom where all my windows get wet inside. Over the course of two days there will easily be between 8 and 12 litres of water in my dehumidifier every single time I empty it. I do not have this problem with any other windows in my property, so I know that it not to do with my building.
    From what I understand it's rare to have another properties mains water supply actually running under another property foundations. I should damn well think so too! Clearly lazy builders, from what I can see there where plenty of other places to lay the water and sewer pipes. But what I don't get is HOW THE HELL WAS THIS PERMITTED AND SIGNED OFF or whatever? Same goes for their sewer pipe being only some 12 inches from my poor already stressed foundations?
    Another point to note over the years my next door neighbour has continually complained about her high water bills I believe they are aware there could be a problem with water and sewage but it does not affect their property even though it's all their effluent and foul waste so my belief is they are trying to make sure that they are left out of the equation.
    I find it very odd that they have decked and paved their entire front and back gardens, yet for some reason they managed to build up, against my porch wall with soil and make an excuse for a flower bed (the only one in all their property!!) which is just two inches beneath my damp proof course which is also where their stack pipe enters the ground which is also where the manhole is that's 12 inches away from my foundations! Oh and also where the mains water enters their house!
    Here are some photos to give you a better idea.

    Both our water meters are situated to the far side of my driveway, please check the attached photo of the buildings layout. When looking inside both of them my one is clean and clear and their one over the last three years plus has been surrounded with thick mud which is coming up from underneath, not the other way round but the water board said that's not unusual and often happens, oh really?!
    My front garden is paved with small bricks and I have not bothered to weed it this year, and would you believe it? There is a distinct line of green weeds growing above exactly where the mains water supply pipe runs for next door!

    If I had a pound for every single hour that I've spent online trying to find out every aspect of this style of building, how it was constructed by what kind of cowboy outfit but kind of problems it'd bring, what problems are encountered with poor workmanship on groundwork drainage systems, believe me from the onset I've tried everything from the roof downwards. Plumbing, all kinds of water ingress problems through endless investigation and knowledge gathering I have lost very many weeks/months etc etc - I would be a multi-millionaire.
    I am angry I am so angry that if it is not resolved soon I will take a pikaxe to these utility pipes myself. I don't think anybody else would be able to tolerate what I have for as long as I have without going barking mad. From the start I have investigated my property and only my property for all these years and it's never had a problem. Being nice and being polite got me nowhere. So this is why I've had to look outside of my property for the reasons to get answers to cure this once and for all. So it's evident that these problems are caused by utilities underground for my NEXT DOOR NEIGHBOURS! WHY WHY OH WHY have these pipes been buried under my foundations. There are about another 30 or so properties of the same 2 & 3 bed design BUT NONE ONE THAT I CAN SEE FROM WALKING AND LOOKING HAS GOT A MASSIVE BODGE JOB LIKE MY PLACE HAS!
    Next door neighbour is a botch job diyer, now he has taken it upon himself to re direct the run off from his gutters since he built an extension to the right of his house (it has no guttering to mention). I noticed all the gutters are directed to the left toward my property and all go down the drain that is there along with his sewer line, mains water supply and ALL WITHIN A FOOT OF MY FOUNDATIONS OMG!

    ULTIMATELY I NEED TO KNOW HOW I CAN GET HIS WATER AND SEWER LINES REMOVED FROM MY UNDER MY PROPERTY WITH IMMEDIATE EFFECT PLEASE.
    I am 100% SURROUNDED by all my neighbours water, waste water and effluent, to the front of my property I have his mains water under my land and foundations, along with his sewer under my foundation and under my front garden to the sewer in my drive, all his water pipes running the length of the party wall, so thats those two walls. The other two walls, in my back garden his grey water runs just two feet from my back door the length of my garden then turns to run the length of my garage to my drive to meet the sewer water. So thats all of my walls surrounded by their S**T. My water and waste go straight in and out. The attached plan of pipe layout etc should show this. I am beyond distressed. This is ruining my health, my life is spent desperatley trying to free myself from an extremely unfair situation that I have had to struggle with for all these years, infact to the poiint that I have recently managed to discover that mains water and sewerpipes are very very rarely permitted to go under the foundations ofd a neighbouring property. Plus there is loads of room for the pipes to be laid outside of my home. I am literally a knats whisker away from digging down to these pipes myself as actually trying to get any authority or even paid help has left me hardly any choice and this is truly driving me wild. Please help. My life will be altered beyond I belief not having to deal with this much longer and to not breath in air that is saturated with the stench of their sewer wafting around my home. Also they have around 4-6 people in and out all the time, I live alone.
    I have had no joy with the council, building control, enviromental health,water company a RICS guy and a guy from one of the UK's largest leak finding specialists each of the last two charged me £500 EACH and they where useless.
    Just to add, I am in contact with water company AGAIN am awaiting a call from them, will update when I know more.
    There is much more to all this but I have tried to be concise so if any other information is needed please let me know and I will supply it.

    I need any help or advise possible please. I could go on as there is so much going on BUT these are my primary concern.
    To conclude the smell makes me feel sick, gives me migrains for days on end, makes my eyes water and sting.

    Who is the water supplier in your area?

    I would suggest calling and asking to go through to their Operations team (tell them it is waste) with regards to sewerage. Don't be any more specific, just say that you want to discuss a sewerage problem. Now, I know you have said you had done this previously... but you didn't have a Callie on the case then.

    If they start with "it's not our responsibilty" tell them you are aware that anything up to the point of the "communication pipe" to the property is infact their responsibilty and that you know that as your waste water supplier they have a duty of care to investigate this and prove where this is coming from. They may start off with the whole "get a plumber", advise them that you know that you know that since 2011 the sewerage pipes that connect houses to a main sewer are the water provider's responsibilty.

      Please telephone our Technical enquiries team on 0330 303 0368 (calls charged at local rate), lines open 8am-7pm Monday to Friday, 9am-1pm Saturday who will arrange for the problem to be investigated

        I honestly have no idea. I have asked a few friends via facebook (yep I spoke to my former company's webchat boys- its cool they owe me a coffee or three!) No one is too sure, this would depend entirely on your pipework I am reliably informed.[/COLOR]

I have asked said tech gremlins that I worked with and they both sent head scratching emojis, the only possible explaination we can come up with is dodgy double glazing filling with condensation, due to your next paragraph.

        Unfortunatly this is down to the builder/developer. The supplier has no responsibility as to where pipes are laid.

        my comments are in blue. Literally all I can suggest is giving the water company hell and going to the Ombudsman and give these guys a bell.

          Sealed units cannot fill up with water only broken ones can nothing to do with water from neighbours mains either unless there is a visible shower from below or above window,looks like sealed units need replacing

            Thank you so much for taking the time to read my long post and for your reply.
            My water supplier is south west water. Yes when I've contacted them numerous times in the past over these issues, they always try and wriggle out of either the water side or the sewer side. Fact is they are responsible for both.
            The last letter I had from them was dated 25th aug 17 regarding our phone convo on 29th march 17 to do with them having come out, oh and the post mark on the envelope is 4th oct 17. It says this. - our clean water & waste teams have made several visits to your property and confirmed that there are no issues with any south west water assets that could be causing the smell and damp ingress in your property that you have described to us. It then goes on saying what they did ie cctv and one of their clean water inspectors who met me at my property confirmed that there were no leaks in the area!!!!!?? and they go on to say - We have established that this is a private issue and unfortunately exhausted all avenues of enquiry regarding this matter!?
            I got straight on the phone to them, I was utterly disgusted and told them that their last letter to me was definitely NOT the last of this matter. I also informed them that a satisfactory survey was not done in the slightest. What about the 6 manholes dotted all around my property? I asked them, they have been untouched for the last 25 years and they are not put there as a decoration. If I could open them believe me they woukld have been opened up ages ago, but as I think I said, NO ONE could open them, they all whimped out, which left me feeling angry and anxious with their total lack of regard and just turn their backs and walk off, & that's not just the water company but the RICS bloke & insurance bloke, plus previous water people over the years, I offered to get my sledge hammer out & smash all the stuck manhole covers if need be.

            I was not happy with any of the times cctv has been used as I don't believe that they look thoroughly enough as they do not look the full 360 degrees and they are too quick, it felt as though they where only looking for a massive clue such as a bunch of roots or a gapping hole. Instead of what could easily be a hair line fracture or not joined correctly at whatever points or turns or whatever. On more knowledge gathering sessions I have read that there are some 7-8 methods of detecting leaks underground, (especially the more tricky small ones that go unnoticed for years until subsidence occurs) Anyhow from what I gather all those technologies have pros and cons as to their detecting abilities. This leaves me deeply suspicious of them only using one method to investigate. It starts to get confusing for me now as it all depends if I'm dealing with a water or a sewer person with my concerns.
            Besides I have (I hope) made myself very clear this time as to what and WHERE they need to be looking. If they don't sort it out this time I feel the only option left for me will be to take a pik and dig the lot up myself and that means the floor inside my vestibule as well as my garden and if i need to remove a block or two from the party wall then so be it. I can not take much more of this vile horrid smell. I know its from next door. I also know that as they are not suffering smelling their own crap all the time, then they will shy right away from even hearing about it same with their mains water pipe, its not affecting them is it, plus the last thing they would want to do is pay for their problems that are affecting me.
            They are ignorant, I know they've lived next door to me for some 16 years or so and believe me they-he has done some really stupid idiotic diy in that time
            I don't know enough about the procedures from the start when these houses where built by an bunch of cowboys. I.e who signs what off when the ground works are done? Also, at what point they are inspected, and who gives the authority and the ok to allow the water and sewer main to run under the garden and foundations of the neighbouring property when there is clearly more than enough room to run their pipes up THEIR DRIVE WAY? It beggers belief, it really does. I'm guessing it must have something to do with either south west water or building control, no idea, but oh boy do I want to find out what brain dead idiot actually saw it all (if anyone even did) and took it upon themselves to say yeah might aswell stick em ere, tis underground so no ones gonna be none the wiser? I do seriously wonder.

            Best case senario for me -BOTH WATER MAIN AND SEWER FOR NEIGHBOUR TO BE REMOVED FROM MY LAND ASAP IT IS SERIOUSLY IMPACTING MY PHYSICAL AS WELL AS MENTAL HEALTH

                Today has been spent asking old mates in Operations about the smell side of it. They are amazed nothing is being done!

                Are the investigations done with you present?

                With regards to a leak, this is where the problem arises. Unless your neighbour formally complains about the bill and asks for an investigation S/W won't do a thing.. it may be worth calling them with your neighbour present so you can both demand an investigation.

                If you can find out some more info I can help a bit more.

                1: How many occupiers (including children under 16) are in the property
                2: Is your neighbour absent from the house for the majority of the day?
                3: Does your neighbour have a bath or shower- and are they power showers or normal?
                4: what range is your bill in (i.e £50-£100 each 6 month) I don't need the exact figure a rough estimate will be perfect also is that consistant for 12 months or longer?
                5:What range is your neighbours bill in (again rough estimate is perfect) again is this constistant or is it increasing?
                6: Does anyone in your neighbours house have a medical condition that means they need more water? THIS INCLUDES DIABETIES.

                I know these questions seem personal but based on your answers I can give you an indication of wether in my professional opinion your neighbour has a leak or not.

                Have you spoken to OFWAT?

                I do encourage you to speak to consumer council for water too, also get your MP involved.. water companies particularly hate this.
                They also hate being reminded that regulation is coming.. but I didn't say that

                  Thank you for all your replies. With regard to the FREEZING all year round party wall, the water pipes in that wall are all for the neighbours, I have a pretty good idea how the pipes are laid out also. It was a friend who is a plumber in London who mentioned that any water pipes in any such a wall MUST be sheathed as they will have condensation on them, apparently this came in to force around the start of the 1990's, house was bodge built in the mid 80's. I also discovered that party wall solicitors are a law unto themselves and charge a fortune. I do not have any money, let alone the kind of fee they would be looking at BUT I have to get this sorted out soon as it has dragged on to long. I am fighting to keep my emotional head above water as have so many other ardous life changing things that I simply must get done. It's a case of it doesn't rain it pours.
                  If I knew it would make any difference part of me would like to straight round to my neighbour and lay my cards on the table and tell them HOW IT ACTUALLY is. They have known from since they moved here that I have issues with water and disgusting foul stench in and around my home. Hell they've even mocked me on occasion with words like are you STILL trying to sort your water problems out? Havn't you sorted it YET?
                  The thing is they have moaned for years about their high water bill, ages ago they had oil fired central heating installed, this was shortly after they had shown me black mold growing in the corners of their bedroom. A few years later when the copper pipe in the floor of their downstairs loo sprung a leak, some months after that I went to collect a parcel that had been left with them and when she opened the door I noticed she had a dehumidifyer running in the hall not far from the party wall at the front of their place. I said nothing but my thgoughts where this, I thought the central heating would of eliminated the need for a dehumidifyer? I also found out that he has re jigged the bathroom, the wc and the kitchen and in the midst of all that got rid of the copper hot water tank and had an electric water heater installed downstairs in the kitchen. So I suspect, that through their stupidity and ignorance, they have tried everything INSIDE their house to cure their expensive water bills but it's not working . I have a strange feeling that they may well even have a good idea that its their pipes ruining my life and home. I actually have manholes in total on my property and I think they have just one, and he put decking over it! I have NEVER EVER seen them even look at their water meter or maintain any of their drains.

                    are you in the right place!

                    We have a sister sight Just Beagles which can help find solicitors etc.

                    I would be tempted to pull a fast one as they say, tell them that you happen to know that if there is a leak under certain circumstances you can get a leak allowance to help cover the costs of repairs and high bills.. but they have to have an investigation firstly. Tell them you have a tame customer service agent who has offered to see if the usage is normal!

                    Also a gentle reminder that he should have applied for a build over permit to put a deck over a manhole might swing matters too keep badgering about the smell, unfortunately there is nothing SW can do unless your neighbour complains too

                        technically, you need a build over permit to lay a patio, depends on the company and how much noise other people make about it.

                        I've known agents say, nope not needed and others saying yep, have to do it so we know we cannot freely inspect them.

                          Has the OP got the water company to accept the drains on his property are their responsibility most drains on private property are not I know ours are our responsibility as is the water main beyond the water companies stopcock which is normally near the path/roadway

                              IMHO this seems to be an attempt at S/W keeping out of a neighbour dispute.

                              That being irrelevent, the smell of sewerage is something they should be dealing with, they will probably (rightly) say they are not responsible for the layout of the pipes (they aren't. just the water up to the Communications Pipe) but I don't understand why they are not reaching out and saying, look there are all these ways we can help.
