Hello to all.
We have a delivery driver working for our company in Braintree, Essex. Unfortunately he lives in Kent. At present he has full use of the Work Van to go home in. However this was allowed as he was originally living in and his base of operations was Southampton. The issue is the company is constantly paying expenses they feel they can cut back on (fuel, wear & tear, dartford, wages for not delivering).
The company seem stuck as his contract states he starts work at 08:30. This is from the second he starts driving the work van, but they are losing 2 hours in the morning waiting for him to get from Kent to the yard before he can start his first delivery, usually arriving for around 10:30.
Now, the company are looking into removing the vehicle from him and placing it in Braintree, making him drive hi own car to work so he can start work at 08:30 as required. The problem with this is they are unsure if this would still affect his available driving time as he has had to drive his car for the two hours in the morning and evening.
Can anyone advise if this change will either be A) legal or B)affect the available driving time under GB Rules. I am aware of the rules in the regs somewhere, where it says if someone has to drive to a place that is neither thier home or workplace to collect the vehicle, but doesnt say anything about driving to work before driving a van.
Any help anyone can give would be greatly appreciated
