    I'm guessing that you are attaching pictures of the site signage to the POPLA appeal?
    If so, keep these & the NtK safe for possible future need if necessary.

    The out-of-time NtK should blow this out of the water.

    It would appear that, despite the change of parking companies on this site, confusion still reigns.

      Yes, I'll attach the relevant photos from above (minus the yellow stickers covering the dates etc).

      Sounds like the confusing set up has been a nice little earner for them-such a distasteful way to make a living...

        remove your second paragraph. If the NTK was valid you would be liable for the charge under POFA as the keeper and not the driver.

          POPLA APPEAL WON!

          Thanks to everyone for their help. I got a reply from POPLA saying Smart Parking never even contested my appeal, so that I won by default!

          There is also an article in the Guardian about this notorious car park, which is currently attracting a lot of attention:

            From the Guardian Article
            Iceland confirms that customers have to exit its Lowther Street car park via a car park managed by Smart Parking, but that it does not employ Smart Parking to manage its spaces. It says the store is aware of one incident where a ticket was wrongly issued by Smart Parking because cameras monitoring vehicles leaving its car park wasn’t working.

            Smart Parking, whose practices I highlighted in July, takes a month of reminders to respond to this and, when it does, it claims, erroneously, that it was brought in to manage Iceland’s parking arrangements.

            “For those motorists who do receive a penalty charge whilst using the car park, we operate a British Parking Association audited appeals process with the final arbiter for the industry being the independent Parking on Private Land Appeals service,” it adds.

            “In this case, the charge has now been cancelled.”
