    I vt'd my car with startline motor finance and took it myself to manhiem they have looked over the car and want 1300 for damage to it they want nearly 200 pounds for tyres but I put it through an mot on the Wednesday before I took it on the Monday. I have sent the letters on here about the damage. Please help.
    This is the letter I got back this morning.
    Further to your email dated 20th September 2017, the content of which has been noted. We can confirm that we are not obliged, nor have we agreed to reduce the damages outstanding.

    We have no evidence to suggest that any of the damages on the vehicle were present at point of sale, you stated that “photographic evidence was taken prior to the vehicle being transferred to you”. We were not provided with any photographs from you by email, or by post.

    When you signed your finance agreement on 30th August 2014, you agreed to several clauses in relation to the general maintenance of the car and her right to end the agreement early. The finance agreement clearly states that it was your responsibility to examine the vehicle thoroughly at point of supply, before accepting it to make sure there are no defects that can be found from a visual inspection. This indicates to Startline Motor Finance (SMF) that there any obvious damage at the point of sale, did not exist.

    Since all of the damage is visible, it’s unlikely that you would’ve accepted delivery of the car in that condition. Further to this, prior to your termination, you have never notified us that any damage existed occurred during your ownership.

    Under the terms of the Hire Purchase Agreement, with reference to clause 10.1.3 and 6.1.1, SMF would expect the vehicle to be returned in a good condition and in a state which shows that you have kept it maintained in line with the manufacture service schedule, along with all registration documents, keys, road fund licenses and MOT certificates.

    When your agreement has been terminated, it will be assigned to Link Financial Outsourcing Limited (LFO) who will request that a payment arrangement is set so that the outstanding balance can be paid over a period of time and in line with your affordability.

      Your situation is no different to anyone else's on here. You have two choices, either pay up or dispute it.

      There's not much I can do for you as this is entirely your decision as to what you want to do, there's plenty of threads posted on here about vehicle damage from a number of lenders - some take it further, some dont. If you have already sent the letters about damage on here then you are already aware of the guide as per the link below but you might want to re-read it again and familiarise yourself.

        I have disputed with them but they sent this and not sure what to do now. Will have to go to the ombudsman I presume.

        Bearing that in mind I disputed it when I got the phone call about the charges but they still sold it at auction then sent me this today.

          You can go to the ombudsman, you can ignore it and wait to see if they pursue it by issuing legal proceedings or pay up. Those choices are up to you and no matter how many letters you send back and fourth, they're unlikely to write it off. Just make sure you took photographs before handing it over so you have your own evidence just in case.

            Yes I've done all the photos and everything you said in your thread.

            It is just that they have stated that they will be passing it over to another company so not sure how to handle that

              If you are going to dispute it, then I would suggest that you keep an eye on your credit file over the next couple of months at least and see if there is any dip in your credit score. Noddle offers a free credit report and Money Saving Expert also offers a free credit report from Experian if you sign up. Lenders can be quick to report defaults to credit reference agencies as an aggressive means to get people to pay up but they also run the risk of being in breach of the Data Protection Act because if it is a genuine dispute and they've not taken them to court over it then it is likely seen (by the ICO anyway) as unlawful and in breach of Principle 4.

              Link Financial is a debt purchaser so it might either be passed to them where they will either be acting as a debt collector for Startline or they will have purchased the debt from them. If the latter, then it is possible that Link might end up making an attempt to pursue the matter further by issuing proceedings against you but I've yet to see that happen, though do not take that as meaning it will never happen.
