    Like I said I am not taking out a debt solution over a small debt of £931.

    On another note I have just found something useful and wanted someone to clarify.

    Drydens state that I was not given a copy of the covering letter that came with the notice of assignment as it contained "priviliged information".

    Can I use this argument "Lord Denning states in the Pelias Construction Case (Van Lynn Developments v Pelias Construction Co Ltd 1968 [3] All ER 824) where he said the debtor is entitled to "view the sale agreement to ensure that the assignee can give him good discharge under the contract."

    Drydens won't reply to the deed of assignment.

      Hi Spellkaster

      I do really really think you have enough to fight this and as I have said before, please try to stop stressing and stop communication.

      If and I say if they issued a court claim that would be the time yo ask for the Deed and mention Lord Denning and Van Lynn developments although if you want to keep busy find the exact paragraphs where he says that so you have another duck in a row.

      As you only have the one debt now it would be crazy to follow a formal insolvency.

          I provided a detailed income and expenditure, and a copy of my medical records showing all my dianosis and treatments currently being received.

          They agreed to write off nearly £10K worth of debt!!

            Yes I remember you saying that but I was curious when this happened and how they phrased it. How long did it take you to achieve this. I'm trying to help a student friend of mine whose sister is quite poorly and has a lot of debt.
