    Default Employer gone mad?

    I took four days off sick recently with a bad back. These four days fell directly after my three rest days. I phoned in sick on my first morning due back, as you would. Now my employer is saying that they now count my rest days as sick leave also, amounting to seven days off. I have never heard the likes of this before. Is this legal, and can they get away with this? Thank you in advance.

    I would suggest you get a copy of your company sickness policy as I'm sure like most it will say that when you inform them is your first day of sickness and then a variety of other stuff about keeping in contact etc. I'm going to take a stab in the dark and say you work on the railway?

    That's like saying if I phone in on Monday after breaking my leg on Sunday playing football that I went off sick with a broken leg I didn't know I was going to get on Saturday.

    Hi Jag...sorry, ...No, I work for a very large international company at Heathrow Airport, and have worked for them for the past 10 years, and this has never been the case in the past. It's madness...

    When I worked for the railway, sickness started the day you reported it.
    I have never heard of your days off being counted before that's almost saying they expect you to be mind readers and know when you will be ill.

    We had an issue with my OH a couple years back, he'd booked time off over Christmas, and it was denied, fair enough. Then he actually was really ill ( ruined Christmas ) and had the same time off sick. Realise it really didn't look good but he had notes from the Dr and whatnot and they still went through disciplinary procedures. He left soon after lol.

    Ah okay, the reason I asked is because of a Railway Policy called MFA (Managing For Attendance) that bosses are forever trying to get their employees into as it stops them being able to apply for promotions and is perceived to keep folk in line. The rules of it are crazy, but if you play the system right you can have a couple extra weeks holiday a year and those who are genuine with their sickness seem to get penalised. It does the exact opposite of what it's supposed to do.

    It takes 6 sickness days or 2 instances of sickness in a 13 week period to find yourself in the MFA disciplinary policy and a year without a single day of sickness to get out of it.

    I thought it was the old MFA trick, six days in a 13 week period stage 1 nonsense to trap the employee in. OP Works at Heathrow though, so not railway.

    AH MFA! didn't think of that tbh. Our Station Manager was pretty cool tbf, he would look at every individual case. If it was obviously pulling a sickie God help you but in things like this, it was the day you called in (unless you said otherwise - i.e I've been ill all night)

    My boss was an idiot, so after the first time I got penalised for being genuinely sick (about 2 years into being employed without prev sickness) I just decided to join the masses of the mess room and play the system. Every railway diary I have ever seen has a date in it 13 weeks from the last day the owner was off sick for four days.

    Hi,

    The employer has a duty of care to record the time the employee is actually sick, helping avoid hard working, endebted people (me!) covering up potentially life-threatening illness to keep getting paid.

    A problem is that punitive systems (including paying the pittance of SSP) and discipline for certain patterns of absence have been introduced 'cos some lazy, dishonest people (a minority) put "a cart and horses" through the old policies. In My Humble Opinion as always.

    So what to do? Maybe learn from the "old hands" and "game the system" in future, say you is ill only on that day. OR join a Trades Union and resist these policies. OR join a (usually smaller) firm where people give a damn about each other and the health of the firm as a whole...

    Ah, you old Hippie Viking! You'll be painting your longboat with flowers and peace signs next...
