    Ive let him know but he thinks they'll just do what they want, like they did with the disciplinary and appeal. They breached their own procedures to give him a higher sanction for breaching procedure; it doesnt seem right.

    How legally binding is a disciplinary invite letter? His invite letter did state he would only be sanctioned if they could substantiate the allegation. By issuing the warning they have contradicted the invite letter as well as going against their own disciplinary procedures.

      Just an update. A grievance meeting was held and as suspected it was a waste of time. Employer would not accept that they breached their own procedure by giving the warning and they closed the matter.

          Unless acas has the power to force the employer to abided by their own rules I dont see what use they will be.

          My original question on this thread was 'was the allegation reasonable?'. It seems an employer can allege anything they want.

          My question now is, was the sanction reasonable? If it was, then it means employers can not only allege anything they want, they can also give out sanctions without substantiating the allegations. That makes the whole disciplinary process pointless.
