  • Overtime

    Hello,

My friend started off as a 'runner' for a civil engineering company, in his contract it states he is entitled to overtime when he does it.

The company placed him on a jointers course and is working full time on price work (e.g. paid off each joint installed), PLUS any overtime that is required. However the company has stopped paying overtime and is just getting paid for the joints he installed. They say it is not in the jointers contract... But his contract is for a runner still which does...

Is he entitled to this overtime AND the priced work?

Is he only entitled to the priced work?

Is he only entitled to the overtime plus his normal salary?

    Please can you help.

    Thanks

So does he want to be a jointer or a runner? If he his happy to be getting piece work rate then I wouldn't expect both.

A jointer, but he has been getting paid for both for some time, then they suddenly stopped it without prior notice.

        is that allowed?

            Re: Overtime

It sounds like the company has been a bit lax in sorting out your friends contract in regard to his new role. It is clear that both jobs have a different pay structure.

I would get our friend to go back to the company and ask them to provide him with a contact for a joiner which should state the new pay conditions for this role, it would then be up to him to decide whether to accept these terms or not.
