  • Help please - County Court Claim - Parking Eye

    On 9/05/2015 a mobile rang when the car was being driven. The car entered a car park to answer and drove to bottom of hill where there were no parking bays painted on the ground, and the call was answered. It stayed for around 15 minutes and then left, without anybody ever getting out of the car. Then I received the letter with fine a few weeks later. I appealed to Parking Eye unsuccessfully, then I appealed to POPLA ( which was decided on their behalf by a firm of solicitors ) unsuccessfully.
    Now I have a County Court Claim Form saying I need to pay £100 - amount claimed, £25 - court fee, and £50 legal representatives costs.
    Do I need to pay the £175? It feels very unfair and completely excessive for a very brief stop to answer a phone call. Any advice on how I deal with this? Do I present a defence, and if so, what should it say? Can I ask for the case to be heard locally so I can appear and defend my actions?

      File acknowledgement of service.

      Post up the claim form and PCN and signs (if possible). Sanitise personal info.

      There is little point paying £175 as that's what it will be if you lose.

        Please find attached Claim Form. I no longer have the photos of the bay's with no markings, but I did submit them as evidence to Parking Eye and POPLA appeals.

            It's half way down on the right under "Important note" 4 bullet point.

            Try the golf club management to see if they can get it cancelled.

            Any chance of pictures of the signs ?

              Hi Mystery 1,
              I have left a message for the golf club to call me back. The car park is 20 miles from where I live so I can't get there easily to take more photos. I have acknowledged the court claim and said i intend to defend all of the claim. I hope this is right.

                    Not in terms of your credit record, unless you fail to pay within a month.
