  • Should i send statute barred templates to DCA?

    Hi there. I made my first post on here recently so hi again!

    I am being chased up by Capquest regarding a couple of old debts with HSBC. I have wrote to HSBC recently with a Subject To Access Request. I have been going over the mound of paperwork that has come back from HSBC today. It appears that the debts I am being chased up defaulted between May and July 2010.

    •Can I therefore assume that both are statute barred?
    •Would you send Capquest statute barred templates?
    •The debts are a credit card and an overdraft. Does statute barred apply to overdrafts in the usual way?
    •I have had a look around the site but cannot seem to find the statute barred templates. Please could somebody point me in their direction if you believe I should use them.

    I have repeatedly asked Capquest to tell me the status of both debts but they never answer the question.
