  • Brodies Letter - Notice of Court Action Consideration

    Hi Guys,

    Excellent forum first of all, been a massive help so far.

    I am currently out working in South Africa and have received a letter which my dad opened regarding an old debt. He panicked and called PRA group who said that they could not deal with him due to DPA.

    This was followed up by a letter from Brodies solicitors here in Scotland stating that they are thinking about pursuing my MBNA/PRA debt of £4099.50. They have suggested that they will apply for a Decree and this can result in my credit file being affected and so on.

    I have sent off a CCA request to PRA Group and Brodies, is there anything else I should do just now or just sit and wait. They have stated that I need to get back to them by the 12th of June otherwise they will "consider" court action.

    Will the CCA request put a hold on the threat of court action, my understanding is that they have to supply this to me otherwise the debt is not forcible in a court of law?
