  • Ongoing issues with very old debt and 1st Credit - advice needed please

    Hi all

    I am hoping you can provide me with some advice please regarding a 1990s debt.

    25 months ago I requested a CCA from 1st credit and had a letter back to say they were looking into it. Since then all I have received are statements, no requests for payments.
    Yesterday, 24th February 2017, I received a letter from them entitled 'Copy Statements' dated 16/02/2017 with the following wording:

    "Further to your request for further information, please find enclosed copy statements showing how the debt is derived. Due to the account entering into collections, it has been necessary to supply an additional post default payment history. This is a snapshot and can be found at the back of the statements.

    We hope this satisfies your request for information.

    Please contact us within 14 days of this letter to discuss repayments of your above mentioned account."

    Now, clearly they have not responded within the required timeframe and neither have they provided anything of the original agreement, terms and conditions etc. I am assuming this means they are unable to provide a copy of the CCA, but how do I respond please? No payments have been made to the debt since November 2012.

    Have you still got a copy of the CCA request you sent to 1st Credit? Did you use the template from LegalBeagles?

    Can you share a copy with us but remove any personal details first please.

      What was this debt which you opened in the 1990s? Was it a credit card, personal loan, bank account, catalogue account, 'doorstep loan' etc?

      Who was the original creditor?

      I note you last paid towards it in November 2012 so were you in a Debt Management Plan at that point or was that when you stopped meeting the contractual payments? Who was that last payment made to?

      I've asked that last question in case you're heading towards Statute Barred which can impact on the the way you manage this situation.

Iunderstand that under the Consumer Credit Act 1974 (sections 77-79), I amentitled to receive a copy of any credit agreement and a statement of accounton request. I enclose a payment of £1 which represents the fee payable underthe Consumer Credit Act 1974.
        I understand a copy of any credit agreement alongwith a statement of account should be supplied within 12 working days.
        I understand that, under the Consumer Credit Act1974, creditors are unable to enforce an agreement if they fail to comply withthe request for a copy of the agreement and statement of account under thesesections of the Act.
        I look forward to hearing from you.

          Thank you for your reply.

          It was a personal loan with Lloyds bank.

          The repayments were initially arranged through the CAB and the account was later transferred to BLS. The payments were stopped when the account was transferred again to First Solutions. I did not stop the payments myself. I tried to initiate payments but they were not being co-operative. Eventually it went to 1st credit.

              I am not 100% sure as it was so long ago but must have been mid 1990s?
