    hi can anyone help me with how i go about this, had a secured loan with welcome finance and was in dispute over charges put onto the loan, welcome have sold the loan onto to another company who is now applying for a ccj. this loan has been passed around to several companies and each i have asked them to provide original documents of the loan agreement and they have not done so. now i need to apply to the courts with my plea how do i go about this do i part admit ? might i add there is already a charge on my property for welcome finance i need help asap please,

    When did you receive the claim and what is the Issue Date (top right on first page N1)?

    You say the debt has been passed around several companies and you've asked them to provide the original agreement but nothing has been produced. Did you send a formal s.77-79 CCA Request with a £1 postal order for the statutory fee?

    When did you take out the secured loan (what year?)

    How much was the loan when it started and how much is being claimed now?

    Finally, can you type up the wording of the Particulars of Claim leaving out anything which could identify you.

    Sorry for all the questions but it helps to have the full background before making suggestions.

      i recieved the claim a couple of days ago and the date is 8 feb on the form. yes i did send a £1 postal order the loans was taken out in 2007. the loan was for £20,000 and they are asking for £7432.84. i have paid them approx £19000 back[IMG]cabot ccj ink[/IMG]

        The next thing you need to do is go on the MCOL website to file your Acknowledgement of Service.

        You tick the box which says you intend to defend all of the claim. Be careful not to add anything in the "Defence " box at this stage - it's easy to make that mistake.

        Who is the Claimant (who bought the loan from Welcome) and who are their solicitors named on the claim form?

        You say the loan was taken out in 2007 but do you know which month?

          PARTICULARS OF CLAIM; By agreement(s entered into between the claimant and defendant, the Defendants has failed to pay the sum of 7432.84. the claimant has requested payment but the defendant has to pay the full sum demanded, The claimant claims the sum of 7432.84 and interest unders.69 of the county courts act 1984 at a rate of 8% per annum from 07/02/2017 until judgement or sooner payments. costs. The claim does not include issues under the human rights act1998. The claimant has complied with sectionsiii and iv of practise direction preaction conduct of the civil procedures rules

                It says its cabot finance who bought the claim and the solicitors are

                  Yes, just tick the box stating you intend to defend all of the claim. Nothing goes in the Defence box at this stage.

                  I suggest you then send a s 77-79 CCA Request to Cabot. If you need help with a template letter then just ask
