Sorry do not agree.
I am Ex military 22years and He shot an injured combatant.

It may have been in the heat or aftermath of battle but still wrong.
His duty was at that point to render first aid and not discharge his weapon.

I served for 35 + special contracts service I don't believe he is guilty of murder the JAG did not here mitigating evidence perhaps under pressure from on high.
This was at best a mistrial and at worst Alex was a scapegoat at the mercy of appeasers.

Re: No Justice

I'm not ex military, although have a number of servicemen in the family.

As far as I'm concerned there was an accusation, a trial, a conviction and a sentence.
There is now an appeal, and bail refused.

This is British justice, I was not at the trial, I have not read the transcripts, I accept it.
Whilst expressing an opinion is fine, to claim the accused did not and is not receiving justice, & to compare it with a generalised rant about foreign criminals and IRA terrorists (freedom fighters from another perspective!) is not helpful.
Sorry Nem!

No apology need des8 I have read all of the CM transcripts and the " evidence " that the JAG did not admitted and in my opinion and many others would have changed the verdict.

Scape goats are an unfortunate result of the PC attitude of many in authority.

The man was convicted and now has the right to appeal is it normal for someone to be granted bail for this crime?
At a new trial he may be found guilty or not guilty that's the process that all of us would have to go through

This was a serious miscarriage of just Wales a court martial is vastly different from a normal trial.
Many thousands of serving and retired military personnel supported this bail application and feel how wrong the verdict was.

I think if this guy is innocent he will win the appeal just because ex and serving military say he is innocent means nothing lets remember someone died here

Good morning Wales,

There is even doubt about this which was never put before the CM.

Re: No Justice

While I know nothing of Military law etc, I do know murder is murder. Apparently the victim was dying and Alex said he thought he was in fact already dead when he shot him. This sounds very iffy in normal life, but who can call being a soldier in Afghanistan 'normal' even for a highly trained soldier. No one but Alex knows what was going through his mind at the time. He may have been suffering combat stress and an adjustment disorder as has been suggested. So many of the lads who serve suffer real and terrible mental illnesses only found on return home.
Soldiers are trained to murder, but on the battle field it is legal,as far as I am aware he was on the battlefield at he time so what is the difference please ?

There is so much that was not put before the court martial especially in regard to the alleged "murder " of the terrorist and the battle fatigue the whole unit was suffering.

I don't see soldiers, sailors or air personnel as murderers.

There also is the question of failures of leadership from senior officers.

The recording that the BBC is asking to be allowed to released, and has been refused until it can be considered at the appeal hearings... is that the video of the shooting with the discussion of the Geneva Convention and the C* word used a lot ? or something else ? I was getting a little confused reading the judgment yesterday and not sure if the video that's circulated, and pretty I'm sure was shown on BBC news already anyway, is the one they are asking for permission to release as it sounds like it is. ( see para 26 of the judgment https://www.judiciary.gov.uk/wp-cont...n-20161221.pdf )

Yes It is Ame.

There is a lot more discussion that was not recorded in the transcript, and an awful lot of mitigating evidence that was not admitted.

The reasoning behind the bail application is that refusal of bail is made when there is a clear probability that the individual will offend again, there is clearly no likelihood of this with Alex.

Re: No Justice

Cool - I just thought it was a bit odd of the BBC if they had already broadcast it, so they are asking to be allowed to broadcast the rest of the footage that was recorded and used in the CM which might put the actual shooting part in more of a context? or was the shooting video broadcast in breach of the original order? Just there was no mention of it already being in the public domain which you'd have thought there would be.

Pretty sure bail is refused if there's a risk of absconding too?

Correct but again that would not happen.
I have always thought the Judge Advocate was persuaded ( wrongly) to accept the charge as murder instead of man slaughter + there is some feeling that the individual was already dead.

Military Law ( Queens Regs) The convention + HR arguments + battlefield convention all thrown in the pot did not help.

As said there is a lot more than what has been disclosed.
