    Hi,

    6 months ago I have VTed a car because I had to leave UK for a while. I have done this by emailing to the finance company that I wish to VT and they have told me that the total remaining was around 2000 pounds. But I told them that I had to go home and could not make any payments or sign any of their VT documentation. So I have emailed and sent them via post a letter which says that I wish to VT the vehicle.

    I think if you have signed their documentation you put yourself in a more disadvantaged position.

    However, now I have received an email from Daniels Silverman about a 2000 pounds debt and I have recently come back to settle some stuff but I live in a different address.
    I do not have any registered assets on my name.
    If you have some money left in the bank account can they get access?
    Can they take you to the court if they do not have the right UK address?

    I have try to search something similar in your site but I haven't found anything.

    Are you living back in the UK temporarily?
    Is the £2000 debt actually how much youowe from the VT? Have you asked a breakdown and what proof they have that they are entitled to that amount?

    Yes they could take the money from a bank account if money is in there and they are aware of it but only if they had the right account number and sort code. They could only have access to that after they have obtained judgment against you.

    Yes they can take you to court if they don't have an address for you. Firstly, they would need to take reasonable steps to ascertain your last known address and this could be done through an electoral roll check or a check through one of the credit reference agencies. If you have specifically told them that you are no longer residing in the country then any claim sent to a UK address would generally be considered invalid service and would be grounds to set aside the CCJ.

    They can however, also request permission from the court to serve the documents by email and there have been some reported cases where the claim form has been validly served through someone's facebook account. We are now living in a digital world and bringing a claim these days does not necessarily mean it has to be done by post and the courts are slowly coming round to that.

      Yes I live in uk temporarily.

      Yes £2200 debt is actually what I own to meet the half value of the car. They have not add any other charges or their collection fee which is usually 250 pounds.

      Now I am checking what bank statement I have sent when I did my finance agreement and I have noticed that I have supplied by mistake a statement from my business account instead from my personal statement. However the hire was personal and payment was with direct debit on the personal account.

      Can I close this account ? Would this prevent them?
      Can you apply for ccj using a business account number for a personal case ?
      Can I challenge this mistake of them by accidentally provide finance using a business statement a proof of address.?

        I have asked the question regarding about a breakdown and what proof do you have that you are entitled to that amount.

        And they reply were that:

        We have requested the details and evidence from our client and will email to you upon receipt , we will hold your file in the meantime.

        What this support to mean ?
