  • Checking a county court claim form is real

    Hi,

    My wife has just recived a county court claim form and we are not certain if it is real or not, as I understand the form is meant to be blue in colour? The form she had through the post is grey in colour. It states it's from Northampton and has a claim number but the stamp appears photocopied and so does the form. Is there any way of checking this is real and not just a fishing attempt.

    If the form is real, then as my wife who has mental health problems, I will deal with any posts to find out where we go from here.

        Or use the details on the form, web page and password, to sign in and acknowledge the claim on line. If it works it's real. You do not have to give a defence yet, and preferably shouldn't. Acknowledgement gives 28 days from date of service to provide a defence.

          OK, many thanks for your replies. I will check via the website with the details on the form. If the form is real, I'm guessing the best thing to do is start a new thread as per the first steps detailed on this forum?

                Hi, so this is the current situation. My wife has now had through the post today a letter from BW legal acting on behalf of Lowell. This debt is for a shop direct account (I think it might be little woods) but the letter and court claim state shop direct.

                As my wife has mental health issues and has for the past 20yrs and has not worked for all that time, she has not had any income.

                So my question is what is my best course of action now? Do I register the claim? On the website provided on the court letter or do I wait until two days before the 14 days is up to extend the time?

                Also looking at the pack that came with then form, it asks for income but as my wife does not have a income, apart from PIP, would we use that on the form only? The debt is in her name only. Interesting the title on the letter and claim from states Mr ..... ......., and my wife is not a Mr, so does this make a difference?

                  Do you think you ever actually had a Littlewoods or other catalogue account ?

                  First job you want it to ACKNOWLEDGE the claim - using the details given on the N1 court form - and work through the rest of the first steps http://legalbeagles.info/forums/show...it-Court-Claim - don't leap into accepting the debt is yours and all bona fide until you have ensured it is.

                      Hi, thanks for the quick replies, my wife did have a little woods account. So its best to acknowledge the claim now? The only reason I'm asking, is the only access to a PC is when I'm at work to type up any letters, so by trying to delay the acknowledgment, it will give me a chance to get the letters ready. Is this the best approach? Or should I just acknowledge it now?

                        Acknowledging the claim now won't delay anything (you get 33 days from the issue date on the form once you've acknowledged) xx

                            Ok, here is my update.

                            I have followed the first steps and posted the letters and acknowledged the claim. So here are the details of the claim. It is between my wife and Littlewoods who passed the debt onto Lowell who has instructed BW Legal to act on their behalf.

                            The amount around £800 with costs of court fees £60 and their fees of £ 70, so total debt is now around £1000 This is with interest added, the interest is around £60.

                            My wife has never acknowledged the debt to Lowell or BW Legal and is unsure of when the last payment was made, so what are our next steps?? Is it worth bringing up her mental health?? She has suffered for the past 24yrs with her mental health and has never worked due it. As for the N9A form, where do we stand on this?? As I have said she has never worked and mine is the only income, so technically she does not have an income apart from her one benefit that she gets and the debt is in her name only, also the claim form states Mr ..... ....., with her first name after the Mr bit, are we able to use this at all?

                            is it best to check her credit file to see when the account was taken out and when the last payment was made?? Also for some reason, but not 100% on this, I think when the debt was passed to Lowell, they did not have Portfolio 1 in their name, so that appears to have changed, but again not 100% on that.
