  • Ppi cancellation fee

    Hello,

    I'm after your advice please, as this issue is making me stressed.
    I started by asking a PPI claims company to look into my past history to see if I was entitled to claim missold ppi... They then sent my forms to fill in which I signed and returned thinking this would give the banks permission to talk to them?
    I then received a form saying that I was entitled to claim against MBNA, and which I needed to sign the declaration and return. I went away for a couple of weeks and had a change of mind about claiming so I never returned these forms.
    I am now getting a invoice letter for 180 pounds for a cancellation fee for the work carried out so far? Basically all this company has done is fine out if I am owed money and no declaration form for a claim was filled in? Is this legal? And do I need to pay? What is this figure based on? Please help me!!

    Would this be Bank- Smart ?

    So you spoke to a company on the phone, they sent you some forms which you returned - I don't suppose you kept a copy of these forms ? It is likely these forms were actually an agreement / contract to engage their services and included terms on commission and cancellation.

    How long ago approx was this you were sent the MBNA form that you didn't respond to ? Do you still have that form ? and does it have a deadline on it?

      Thanks for the quick reply. It is a company called Clames4you Ltd.
      I think I might have a copy of the original paper work? I definitely have a copy of the MBNA paper as it's a large questaire... and it was send to me mid July! I have the paper work at home but can't get to them until Sunday morning unfortunately when I do I'll check for deadline dates? I was under the impression that they had only looked into if or not I was owed money and no claim had been set in motion? I want to just end the claim process but feel trapped and can't get away from them....

        What were these forms? Was it a letter of authority giving your consent for them to deal with MBNA on your behalf?

        Also is it Clame4you Ltd (without the 's' ? If so you're not the first to have issues with them http://www.legalbeagles.info/forums/...-Work-not-done

            Yes it is claim4you Ltd without the 's' and yes i think it was me giving them authority to deal with MBNA on my behalf. But I would need to double check?

              Ok.

              If that's the case the T&Cs say..

              On completing a Form of Authority for Claim4you to act on your behalf, you are entering into a contract with Claim4you
              And then...

              You have a 14 day cancellation option which does not affect your statutory rights. After the 14 day cancellation period has elapsed Claim4you reserves the right to charge for any fees incurred in dealing with your claim should you then decide to cancel. This will include a charge for any time, administration and legal fees that the company has incurred in pursuing your claim up until the date of cancellation

              So I think that you may be able to argue that as you haven't completed the form of authority for MBNA, you have not entered into a contract under which they can charge you for a cancellation.

                  Update.... I have had another email from claim4you Ltd saying that they are re-sending me the MBNA paperwork again which should arrive Monday!! I just want to wash my hands of them any avoid the so called cancellation fee...

                        I have made a special journey home this afternoon as I was informed the new MBNA form had arrived.. I have attached the cover letter and can attach more of the 13 page document if required but it looks like it's a generic questionnaire from financial ombudsman service? With the last page wanting my signature for a formal complaint against MBNA...
