  • PCN Paid Twice online with Barking and Dagenham

    I was alerted via the rental company AVIS, by way of a letter send on 21st July and received on 4th August to advice of the Administration fee of £30 in reference to PCN XXXXXXXX, during the car rental of XXXXXX from 24th May to 05th June.

    So I checked online and noted the PCN had a charge of £80, but no information on the offense or any evidence attached on the Barking and Dagenham website. I was concerned that I had received no notice from the Parking Services or that there was an available evidence online. As I was due to travel overseas and wanted to avoid the ticket going up to the full charge and could not make a representation online without the notice proceeded to make the payment on the 5th of August for £80. I received a payment receipt. When I checked the payment still showed as outstanding so I emailed the cashiers and parking services on the 5th August and again on the 6th August. I have had no reply yet to any of the emails.

    The following day the outstanding amount had increased to £120 and was still shown as outstanding, so I send another email with no response and used the chat service online on the barking and Dagenham website, they could not assist. Till today I still have not received the said offence or evidence details or confirmation on the payments. I paid the £120 shown on the 6th August.

    I have now paid the PCN twice, once on the 5th August at £80 and the next day 6th August at £120, I have both receipts and copy of bank statement showing the transactions.

    Can I write to Barking and Dagenham and expect Barking and Dagenham parking Services to respond within 14 days and refund both amounts paid to the account the payment was made from as compensation due to the inconvenience caused, by firstly not providing the evidence or notice enabling me to make any appeal online and secondly a serious error in the payment system that has resulted in the PCN being paid twice at £80 and again at £120, causing inconvenience to my cash flow this month and leading to further stress. If Barking and Dagenham parking services do not agree to refund both amounts paid can I launch a complaint to the financial ombudsman?

    Certainly write and demand they refund the £120(second payment)
    You could ask for compensation, but I dobt you would recover the full amount of the first payment, if any thing at all.
    IMO "inconvenience" will not be seen as sufficienr reason.
    You need to show actual loss.

      Barking and Dagenham have refunded the first payment of £80. I will write to them as they have refunded the wrong amount, how do I request from DVLA when Barking and Dagenham requested for the registered owner of the vehicle?

        Ask them.
        The Data Protection Act gives you the right to obtain information held about yourself fromthe DVLA records.
        Requests for data must be made in writing providing your full nameand address details, driver licence number or your date of birth if your driver number isnot known.
        DVLA does not charge for this service.
        The request should be sent to DVRE5, D9, DVLA, Swansea, SA6 7JL.

          Thanks des8. I have emailed DVLA via the online request for information, as I am currently stationed overseas.

          Does it matter that I am not the registered owner of the vehicle as it was a hire car?

            The council will have obtained registered owner (Avis) details from DVLA.
            The council would then have sent notice to Avis, who would in turn have advised council that you were the hirer
            That advice was the cause of the £30 admin fee.
            On receipt of Avis' information the council should then issue a new PCN to you.
            Avis seem to have taken their time warning you of the PCN, and did you receive a PCN from the council?
            If not could it be that the address AVIS had on record was no longer valid eg you had already been posted abroad?

              I haven't received the PCN yet. The address i used in the UK is my correspondance address. I noticed that Barking and Dagenham have refunded the £80 first paid and not the £120 paid the second time and when checking online the PCN has again has an oustanding amount of £80. Totally confused what to do as Barking and Dagenham will not deal with Issue via telephone. I received a note back from DVLA asking me to fill a V888 form. I have responded to say that i do not need to know the registered keeper, I just need to know when Barking and Dagenham requested for the registered keeper details. I've tried to challenge the PCN but it says an informal challenge cannot be done as a notice to owner has been issued. Which has not yet been recieved.

                You must be one of very few people to pay a PCN before it is received, and to actually pay it twice!
                More often than not we are helping peeps avoid payment.

                All I can suggest is an email to the council's CEO, (chris.naylor@lbbd.gov.uk) explain you are serving overseas and the trouble you are having obtaining a refund of overpayment.
                It may work.
                As you are overseas I doubt you would want to go down county court route.

                  Thanks I paid initially in order to avoid any grief, as i noticed Avis had send me a letter 7 weeks after the return of the rental car and I had not and still not received any notice from Barking and dagenham council regarding the PCN. Just thought it would have been easier to pay up the £80. Looks like i was wrong. Will email the council CEO tomorrow and see if it helps. I may still challenge the PCN if its possible, but without the PCN theres not much i can do.

                    I called Barking and Dagenham this morning, They advised it is a penalty notice for parking in a residents bay without a permit on 1st June and the PCN is still held under AVIS name the car rental companies name, hence I have not received the Penalty notice, They also said the £80 is outstanding as I had been refunded the original £80 and I would need to write in to receive the refund of £120, they could not explain why £80 is still outstanding as they could also see the payment of £120 was done and could not explain this either and I would also need to write in regarding, Barking and Dagenham further advised I should check with AVIS why I have not received the PCN.

                      If the PCN has only been sent to AVIS how the hell are you supposed to know it even exists.
                      It is for the council to issue to registered keeper.
                      If reg. keeper does not nominate the driver the reg keeper becomes liable for the charge.

                      Why can't they just refund the outstanding overpayment of £40?
                      Complete b****y nincompoops.
                      I'd be complaining to CEO about their sheer incompetence.

                        I have emailed the CEO this morning asking for the refund of £120 and requesting that the PCN be updated to the discounted rate, which I believe is £40 for a parking violation. Been calling AVIS customer service all morning and been on hold for 45 minutes so far as I wanted to check if they have indeed send my details to Barking and Dagenham, which they claim they haven't received.

                          I've spoken to DVLA twice today and they say they do not hold records of when details for the registered keeper of a vehicle was made

                            That surprises me as DVLA are supposed to carry out checks and audits on requests if complaints are made about those requesting info eg parking companies.

                              I've now received a copy of the PCN from AVIS, it is a parking violation from the 1st June, for not displaying a valid permit. The strange thing is I paid a parking ticket on that day already, although it is a different PCN number. I've told AVIS that they will need to settle the outstanding fine amount as I have not received the PCN as AVIS has not send my details to London Borough of Barking and Dagenham, AVIS are checking with there own Traffic offense department.
