  • Claim form - Letter structure help *urgent* - won

    Hi,

I have been rather confused by the whole case.

May 2015 Received a yellow PCN ticket on my window - There were no signs, pay and display area's or warnings of private property in any way I was also advised by a company that I was visiting that it would be fine to park where I did.

I sent a letter off to explain the situation and if I had the opportunity to pay I would have.

The next correspondence I have is in a form of a letter from County court business centre via BW Legal demanding the sum of £236.46.

I have since registered online and stated that I intend to defend myself for the total cost of the claim...

I didn't realise but haven't filled out a statement and it is deadline day tomorrow (I believe).... Can you help me construct a defence letter please?

I will be eternally grateful for your support!

    Thank you
    F.

I don't know where to start in writing the defence... the above is all the info I have really. I can also include a snap of the Claim form and the letter sent.

      Thank you for your reply

Have you acknowledged the claim ? You do that within 14 days of receipt of the claim, which then extends that time to 28 days. What date was the claim issued ?

I had nothing from them. only this claim form in a brown envelope with the appeal sheet, but did it online and spoke to someone from that court too and he said all I need to do now is submit a defence letter which ill do online,

26th May 2016 but only received it around 3rd of June.

Thank you for your time and response thus far.

This was my letter I sent them following the PCN. Obviously, i've hidden the address and reg number etc.

Currently, i'm in between jobs too (i'm starting my new post in mid-July if that helps).

Do you still have the evidence that the signs were non existent or poor ?

No But I do have screen shots of location as of google street view with date of August 2015 at the bottom... but sadly I think they put up the most tiniest of signs on a lampost on entry around 10ft high up... even if I looked I wouldn't have spotted it.

Here's a picture of location... of the entrance to the car park (top right)....

There is a second picture of the only entry and exit... as you can see there is a sign on the left in red BUT looks like it's for the gated access to alternative property... there was no signage of any kind in the car park or walking towards the buildings in any way.
