  • First payday loan claim against Wonga

    Hello!
For 3 and a half years I borrowed every month, at least once, from Wonga and Payday UK, between 2011 and 2014. Over 40 loans in total .
They stopped lending to me by 2015, but until recently I had to continue borrowing regularly from Sunny.
Obviously, I do blame myself for this, but feel Wonga and Payday UK didn't help my situation- only made it worse.
I am preparing to make my first claim, against Wonga, who lent me over £5k, 33 loans.
I have used the template letter from debtcamel (thank you!) but I am wondering about the affordability part. Now, I am not entirely sure the info I gave Wonga back then was accurate. I am a little worried I may have lowered the figures a little just in case I couldn't borrow as much as I needed to. I am not saying this was definitely the case- but I wouldn't put it past me! Will this matter? I am putting in the letter what I believe to be a true reflection of my outgoings.
Also, I think my income was around £1200 a month, and the outgoings I've calculated are £1060, leaving £140. Will they look upon this as if I was able to afford all the loans below this amount and only refund those that were above? or will they have to refund all?
Lastly, is the fact that I was allowed to borrow continuously for over 3 years enough to prove I couldn't afford it despite my income and outgoings?
Sorry to ask so many questions, I am just wanting to be sure I'm doing the right thing.
    Thank you!!

As you have doubts do we take it that you were telling a few porkies to enable you to get the loans if they use this against you you will look a liar in court

Well I don't know what I put in when giving my expenditures. I would have given them figures that were as accurate as possible at first, but once I become trapped and couldn't afford not to borrow from them down the line- I don't know if I amended my income/outgoings to reflect that. My expenditures increased when I had my first baby in 2013. They continued to lend to me right up until October 2014. At one point I even had to take out an additional loan amount from them to pay a bailiff who stood at my door threatening to take my things. Yes, it would look bad in court if I didn't give my expenditures accurately in desperation but will it get that far? Shouldn't they have been checking my credit file and doing more to ensure I could afford it anyway?
