    Hi guys abit of advice please would be greatly appreciated.

    have mentioned elsewhere but to recap.

    I recently checked my credit file and saw I was defaulted on a student overdraft account I had with Natwest. The default date is May 2014 which is strange consideringI started banking with Co-Op back in March 2013 and moved abroad Jan 2014 but could be possible, though I did state that there could be a fraud issue.

    I asked for a notice to be placed that I am disputing the debt, they said that I would have to get into contact with Apex Credit Management.

    I still live abroad so I updated my address and they will send the last 6 years of bank statements to me so I can see for myself the last time I actually used the account and how much of it is charges.

    Though the total debt is £2584 but my overdraft was £2000 so assuming everything else is charges.

    I have not been in contact with Apex yet, will wait until I have my statements so at the very least I might be able to have the deault pushed back and have the charges wiped out..

    To be clear at the moment it seems no one is chasing me for this debt.

    I just proactively want to sort this out as ended up with a CCJ for issues relating to mvoing abroad

    DCA have an extremely bad reputation and I lack experience in dealing with them so was hoping for some advice in how to approach them.

    Hoping that living abroad and being proactive might work in my favour in negaioating a settlement. but what advice would people offer in dealing with this?

    Aside from living abroad, I only work part-time due to Arthtistis and could be a long time before I realistically earn enough to pay back the amount so was thinking about offering a F&F settlement offer, or is there a better way to proceed?

    Good afternoon,

    Apex Credit Management is a debt collection arm of the Cabot group of companies, has the debt been sold?

    I would suggest a Subject Access Request under the provisions of the Data Protection Act 1998.
    This should go to NatWest addressed to the Data Controller at its head office address.
    There is a £10 statutory fee and NW has 40 days to comply, bank charges are virtually impossible
    to reclaim since the now defunct OFT lost a test case on charges.
    Getting default dates pushed back is very difficult now as the ICO has opened up the timescale
    on reporting/placing defaults on CRA files.

    A full and & final settlement offer must be made in writing and made on certain conditions.
    The " opening offer" should be no more than 10 - 15 % of the outstanding balance to give
    room for negotiation.
    Conditions should be:
    1. That any remaining balance is not sold or assigned to any 3rd party.
    2. Credit file are to be marked partially satisfied.
    3. Payment would be made with in 7days of your receiving written agreement
    to the offer.

    Not informing creditors that you have moved house within the UK does not help and going abroad
    without doing so is worse.
    If this debt has been sold the purchaser will not be interested in disputes with the creditor.

      Hi,

      Natwest told me the debt has not been sold but Apex are working as agents for them and I will need to get in contact with regarding any form of payment.

      Its just at the moment they are not chasing me, I know the people living at my uk address and have not had any letters from them.

      and yeah I learnt the hard way that not informing creditors is stupid, geneuinely just forgot and now have a CCJ for CC which is way I want to be proactive with this debt, if I could pay it back I would but unfortunately can't.

      My main aim is to avoid another CCJ so is it best to contact Apex and tell them I leaving abroad and give them my new address? I dont want the people where I used to live to be hassled by my debt issues.

      Also what would a SAR achieve? Natwest are sending me 6 years of bank statements, should be here in 2 weeks or so. and if there is no point in trying to get charges or default date changed then how would the SAR help?
