    Hi
    My daughter is resigning from current job as she is unhappy there. She has to give a months notice? as paid monthly? is this correct? Also her holidays go from January to December and she hasnt had any yet this year so is she entitled to any before she leaves? can she be given these in money or just time off?
    She has been ther 2 years since 27th February.

    What does her contract say?
    Usually they are based on the pay period, ie paid weekly = weeks notice
    dependant on the job they may be extended notice required

    Also her holidays go from January to December and she hasnt had any yet this year so is she entitled to any before she leaves?
    She will be entitled to pro rata of holidays not taken
    so we have had 3 months, so she will be entitled to 3/12th of her entitlement

    can she be given these in money or just time off?
    That is up to the employer
    some companies like you off the premises asap, so will let you use holidays as your notice, mainly you will just get the extra pay in your last packet

          Hiya
          She handed in her notice and they were very upset she leaving. Will not know luv until she gets wages what they decide to do about holiday pay etc. Will keep you posted.

            Make sure she knows her rights just in case they try anything on, get her to dig out a copy of her contract or request a new copy from HR.

            When you leave a job you should be paid for your statutory holiday normally four weeks although her contract may state she can not be paid for her contractual holiday anything over the legal minimum.


            Also make sure she gets her P45 or she will be whacked on to minimum wage in her next role.

              They only have to pay you what holidays you have accrued and haven't taken.

                I hope she will be very happy in her new job, it sounds really good, but defo keep her posted on what happens re: wages ect. Plus i also thought you only got the days you had accrued but i could be wrong it has been known lol.

                  Thats what I mean. Obviously you cant get paid for hoilday you have already taken or is not due to you!



                  The legal stuff we give to candidates says:

                  Give your employer the right amount of notice. By law, you must give one week's notice if you've worked for your employer for a month or more. Your contract may demand longer

                  When you leave your job, you should get paid for any unused legal minimum holiday allowance (ie four weeks), although your contract may say that you lose untaken contractual holidays (ie anything over four weeks). If you've taken more leave than you've earned, your employer can't normally take the money from your final pay unless it's been agreed beforehand.

                  If you have a personal pension plan, you can take it with you if you change jobs. If you were paying into a company scheme, you should be able to get a statement of the current value of your pension fund. You may be able to transfer this to another scheme, or into a personal pension plan.

                  If you feel that you have to resign (eg because of dangerous working conditions or your boss's behaviour), you may be able to claim constructive dismissal.
                  If you're thinking about claiming constructive dismissal, you should raise the problem as a grievance before you resign. If you don't, an Employment Tribunal (Industrial Tribunal in Northern Ireland) can refuse to hear your constructive dismissal claim or reduce the amount of compensation you receive.
                  Be careful, though, because constructive dismissal is not always easy to prove.

                      Hi everyone
                      Daughter has been told she can leave work 6 days early instead of having money. She is happy with this as has week off before starting new job!
                      I will tell her about pension etc about maybe taking it with her? Im think she is paying into one.
