  • Parking Eye and going to court

    Hi All,
I received a parking fine from ParkingEye in August 2013 for parking at a Hospital without paying. My circumstances at the time I was rushing my 9 year child into A&E who had just broken his wrist. Therefore my mind was on the welfare of my boy and nothing else. when I received the letter I appealed it, and was happy to pay the cost of the parking space (not the fine) but this was rejected several times. I then went to POPLA who sided with ParkingEye. I complained again but heard nothing back so presumed all was resolved. I received notification from a debt collection agency today saying I now owe then £120. I take it has taken them this long due to the Beavis court case.
Legally yes I did not pay for parking but my circumstances why I did not pay have not been not been taken into account, nor the fact I was at the hospital the next day and paid for parking.
This is a principle thing really and I know the law can not really take into account principles.
If I went to court over this will I get anywhere or just stung with more costs?

    cheers

sounds like a plan to me, appreciate said advice, what do I do when I get the bailiff knocking on my door, or court summons? Or are we at the scary shouty letter stage where I would normally cave in and pay, but actually it will never go any further?

Bailiffs can only chase if you've lost in court then not paid etc

Parking eye do do court but you want to wait as long as possible to find out the result of Beavis which will either be great for us or it'll be time to negotiate. It costs more than it's worth for them to go to court so they'll accept less than the current scary letters say if you negotiate well assuming Beavis loses
