  • The Funding Corporation (VT Termination & Bill of Sale) - Help Needed

    Hey,

    I hope that someone here can offer me some help regarding my Vauxhall Zafira 58 plate which was purchased from ACF Finance who were a trading arm of The Funding Corporation on the 30th December 2011.

    The first year of owning this vehicle was pretty much trouble free however after 12 months things really did go downhill. We have had issues such as the following:

    • 2 x faulty clutches.
    • Seized air conditioning motor.
    • Faulty CIM module.
    • Failed coil pack.
    • Broken central locking system.
    • Failed suspension.
    • Failed linkages.
    • Failed gearbox (most recent fault which occurred last week)



    We have followed the manufactured recommended service routine with the car and really have looked after it at out end however when were first took the car for its first service, there was some confusion about if the car was actually ever serviced. The garage asked to look at the service book which showed that 3 services had been recorded the 3 previous years however no boxes were ticked to show what had been checked or replaced. The handwriting for the 3 services were all very similar, same colour pen and same dealer stamp which was the main Vauxhall dealership local to the ACF unit where we purchased the vehicle from. On first glance it really did look like there stamps and service entries were made up and totally fictional so we contacted Vauxhall to verify them.

    Vauxhall did confirm that 2 of the 3 entries were bogus and no record existed of any service other that the first. They advised us to contact the dealer which we did and they said they did not check the history of any vehicle they purchased as they carried out their own check prior to the vehicle being sold.

    We left it at that and have just since put up with various faults happening on the vehicle, the most recent and major fault happened last week where the gearbox failed leaving me with a repair bill of £1622 Inc. VAT . The cars current valued based on an online valuation site is approx. £2500 and there are 27 months left on the finance agreement leaving me with little choice other than to swallow the costly repair charge on a car which will soon not be economical to repair. The garage have confirmed that they don’t believe the car will last the full duration of the finance term at the rate faults are developing leaving me in the situation I am now and asking for help.

    What can I do? I have heard about voluntary termination however was not sure if it applies when companies used a Bill of Sale, I have also been reading that companies need to register the bill of sale within a certain timescale in order for it to be valid.

    What I want to do is get rid of the car and get something else, ideally I would like The Funding Corporation to terminate the finance agreement and either have the car back or write it off. My credit rating is not great so I am restricted with dealing with subprime lenders to sort a car out.

    Does the made up service stamps carry any weight at all?

    Any help gives would be gratefully received.
