  • Accidental payment made to old debt

    I have a question regarding an accidental payment that has inadvertently been made to an old debt.

    This payment was made to Lloyds on an old credit card, the card has been closed and the debt sold to a third party collection agent. However instead of Lloyds bouncing the payment they forwarded the payment to the third party agent that they sold the debt on to.

    A letter has been received acknowledging this.

    Firstly I wanted to know if anything can be done to recover the amount accidentally paid to Lloyds? Should they not have returned the funds since they no longer own the debt?

    Secondly does this pose a problem with acknowledging the debt?

    How was this " accidental" payment actually made?
    I think yes the payment should have been returned as the account with Lloyds is closed.
    Yes it could pose a problem depending how the payment was made, if it was made specifically
    to the credit card for instance on counter credit slip.
    Have made a formal demand for repayment?
    Who is the " owner" of the debt now?

      Hi Nem,

      The payment was made as a faster payment from a bank account account with another institution.
      The letter has come from Lowell Portfolio Ltd and they have stated in the letter that the account was sold to them by Lloyds TSB on 17/6/15. I think the original default was around November 2007. The letter from Lowell is asking for contact to be made to discuss repaying the outstanding balance which is around 6K.

          Ok When exactly was the last payment made?
          I take it no payments were made after the account
          was defaulted?

            To the best of my knowledge no payment has been made to the card since default, the debt has also never been acknowledged or admitted. To also add that the debt doesn't appear on my credit file.

            This payment was made on Friday, 10 July 2015

              Ok and no company has/is pressing for payment??

              The debt is to mind statute barred, anyway so this payment cannot affect this status, however
              any payment made by mistake after the debt reaches SB status amounts to a gift.
              What happened did you click on a wrong payee?

                  Looks like there was a clear period of seven and a half years without payment or written acknowledgment, in which case the debt would already have been SBd at the time the payment was made. Once a debt is SBd it cannot be 'un-barred' in any way. :grin: :grin:

                    I would complain to the bank. They had no right to forward money on your behalf.

                    When they tell you to get lost complain to FOS.

                      Yes clicked the wrong payee person, Lloyds

                      That's what I wanted to check, that Lloyds had no right in to forward the payment.

                          The letter that came today was actually from lloyds bank with a copy of a letter from Lowell.

                          The only previous letter I can find is from Caplets in January 2014
