  • Help please with santander

I had a Santander 123 account and I moved to Lloyds as I had so much grief with charges that I thought was sorted. I had a payment from Lloyds to the Santander account to bring overdraught down I heard nothing for months then out the blue I had a letter saying I was over my overdraught limit demanding payment. I rang and got told there was a charge of a £1 a day for overdraught which I knew nothing about !!! Then the harassing phone calls started at current we are getting at least 4 a day. I have written saying I am dealing by post as want everything in letter and to stop calling me . I have had reply to say the calls will continue as they need to speak to me on phone. In letter I agreed to pay £100 a month . I am out to work most of day and the calls are answered by my disabled mum but some of them are automated things. Do I have to ring them in past I have rung and they always try and get you to pay more than you say they want to know everything and I am unhappy and not at ease talking on the phone to a complete stranger who that I have no proof are working for Santander. Help would be appreciated

Write to them demanding they stop the harrasing phone calls. You do not consent to receive them. You can warn them that if it continues you will take action under the Protection from Harassment act. There is a court case for reference which involved British gas as the defendant, and they lost.

If they phone up again ask them for proof of their identity. Ask them for today's password, or their mothers maiden name and their date of Birth. I'm sure they'll get the message.

Quote the Roberts - v - BOS Appeal Court Judgement on harassment after a creditor has instructed that All communication must be in writing.
