  • CCJ with Equidebt

    Equidebt got a CCJ against me about 9 years ago for a credit card debt less than £5000 pounds but more than £750 pounds.
    About 18 months later, I was unable to keep making the payments against the debt as I was on JSA.
    I had court bailiffs attend to collect but was out and did not respond.
    After Equidebt went under, would the company who bought the account know about the CCJ?

    Hi welcome to LB
    I believe Capquest acquired a load of the Equidebt book.
    This CCJ would be off CRA and public records now is someone
    chasing this now.

      Cabot bought the Equidebt accounts in 2013, that should have given them plenty of time to contact you. Have you been contacted at all?

      In theory at least, they would have acquired all the data held by Equidebt about all the accounts held by them, including which ones had judgment against them.

      Was that bailiff visit the last time anyone tried to enforce this debt? If I'm reading correctly, this would have been over 7 years ago! If you haven't heard anything since then, or since Cabot took over the accounts, then I'd just keep quiet until anyone contacts you (if at all).

      CCJs don't go SBd as such, however, they can't just send bailiffs out of the blue, after all this time they'd have to go back to the court to apply for another warrant and the court may well question why nothing has been done for so long.

        Debt purchaser Equidebt has gone into administration, Credit Today can reveal.
        The firm’s debt portfolios are due to be sold to the debt purchaser Cabot Credit Management, but 60 of the firm’s 110 staff have been made redundant

          Hi purdiesdad,

          You would have been informed of the acquisition of the debts by another company when this happened.

          As the bailiff visit was so long ago it's no long relevant.

          These old Equidebt debt pop up no and then but usually get dropped when challenged
          on the length of time elapsed and lack of paper work.

            Parrot, Cabot have been in touch, but only their "welcome letter and a recent statement of account.
            Thanks for the reassurance re bailiffs, but do they have the option to use other avenues eg attachment of earnings
            or charging orders.

              They do, but you will hear about it first. For an attachment of earnings, you will receive an N56 form before they go to your employer. You'd have the option to request a suspended order on the basis that the AoE could impact on your employment and put forward a repayment offer.

              If you are a homeowner, they could record an interim charging order. The Land Registry should notify you if that's the case and you'd have to attend a hearing prior to the CO being made final. COs can be hard to fight, however, you'd have the chance to put forward your arguments at the hearing. Having said that, we are jumping the gun here a little. They have only sent you a 'welcome' letter and a statement, they may not be aware that there's a CCJ against that and, if they haven't got it on their own records, they won't easily find it. The CCJ would already have been quite old and off the public record when they bought the Equidebt book back in 2013.
