  • Ross and Roberts being difficult! Help

    This is for council tax rears, we set up a payment plan with RnR but have failed to pay for the last 4 weeks through carelessness if anything, we assumed all was well because we had a Direct Debit set up to pay a £10 weekly installment.
    yesterday we received a letter (the 1st documentation for 5months) that read 'Enforcement Notice' due to the missing payments. I called the RnR direct, they failed to help in anyway, I asked for evidence of payments/account etc but they told me the bailliff has ownership of our debt and he couldn't help, he muttered something and continued to talk before allowing my response he put the phone down!! I called the bailiff who advised me I need to pay at least £200 otherwise he can't help start the payment plan again. 4weeks is £40 in missed payment, today we payed £20 tomorrow we can afford £50 and next Wednesday we promised another £50 my thinking was at least were trying, truth is we can't afford more than I offered and therefore we can't start the payment plan! I read somewhere that they may be breaching certain codes of conduct because A. They say they can't provide me with my records B. Them bring difficult in not accepting all I have to offer baring in my we will be on out added for the next month or so due to this....my kids will be fine because there kids but they will also suffer because of this! Can someone help with the facts? Please...its so distressing, im sick of this!

    How much do you owe? Do you still live in the same Council area? What are your family circumstances?

      Without knowing the actual amount of the debt passed to Ross & Roberts it is difficult to know whether or not the amount being offered by you is reasonable.

        The amount is 750. we have 4 children, currently receiving benefits byt due to start employment in the next 2-3 weeks......we live on a tight budget and are offering more than we realistically can. Currently Salisbury council....we rent through sanctuary housing.

          Unfortunately as the debt is now passed to an individual bailiff an additional fee of £235 has now been charged. The bailiff can only gain entry into your home by peaceful means (usually by invitation) In your case please do NOT let the bailiff into the house. However, if you or your wife have a car then this could be a problem as they can be seized. There are strict rules on vehicle regarding their value and they will be exempt if on finance. Please let us know the position.

          Have you provided the bailiff company with details of your income and expenditure?

            Ok, we have a car but it hasnt been running for 6+months, we did an expenditure form with sanctuary housing before this became passed on, we have struggled to pay it to the tee but we are more or less on schedule with the payments, wee payed £20yesterday and £50 today which actually puts us ahead on our payments but obviously having missed a few we find out selfs in this position! It seems they don't wanna help they insist there's nothing they can do unless I pay £200 exactly, I think its a tactic they use so as to gain money by borrowing from family/friends, they have there own financial probe so I find it hard to ask!

              I assume that the car is not worth very much. If so, and if it is not running then the bailiff will not be interested in taking it and would therefore be more agreeable in accepting a sensible payment proposal.

                I reckon the bailiff would take any car he could just so he can add more fees.
